R ESOLUTION N O. 2020-007
R ESOLUTION A PPROVING P AYMENT N O. 3 AND F INAL FOR THE
2019 M ILL AND O VERLAY P ROJECT (ST199004)
WHEREAS, the City of Plymouth as the owner and Park Construction Company, as the contractor, have
entered into an agreement for the 2019 Mill and Overlay Project. Said agreement was approved by the City
Council on June 25, 2019.
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the request for final
payment.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the original contract amount between the owner and the contractor was $1,686,148.41 and the
value of the work to date is $1,691,299.46 and is approved. The final contract amount is $5,150.05, or
0.3% above the contract amount.
2. That the work performed by the contractor for the 2019 Mill and Overlay Project and certified to the
Council by the engineer as acceptable, being the same, is released from the contract except as to the
conditions of the performance bond, any and all legal rights of the owner, required guarantees, and
correction of faulty work after final payment.
3. Request for Payment No. 3 and Final in the amount of $99,578.90 to Park Construction Company for the
2019 Mill and Overlay Project is approved and the Finance Manager is authorized and directed to pay
the same forthwith.
4. The total project cost is $3,963,946.96 which includes the mill and overlay in the amount of
$2,082,860.66, design, administration, and inspection in the amount of $309,832.64, and $1,571,253.66
for preventative maintenance.
BE IT FURTHER RESOLVED, that the funding for this project would come from the Street Reconstruction
Fund in the amount of $1,744,800.50, Special Assessments in the amount of $1,067,832.04, the MSA Fund in the
amount of $319,551.19, the Water Fund in the amount of $554,671.89, and the Sewer Fund in the amount of
$277,091.34. The appropriate funds will be transferred for 2019 year end.
