BACKGROUND:
On November 21, 1977, the City Council, by Resolution 77 -668 approved a Site
Plan and Conditional Use Permit for a 31,770 square foot office warehouse
building.
On January 29, 1979, the City Council, by Resolution 79 -63 approved a second
Conditional Use Permit for additional office space in the existing building.
On May 1, 1992, the City received a complaint regarding the outside storage of
trailers and pallets on this property. On May 18, 1992, the City inspected
the site and found that a Conditional Use Permit was required for the outside
storage and that this approval had not been previously granted. A letter was
sent to the property owner on September 2, 1992 stating that the outside
storage was in violation of the Zoning Ordinance since no Conditional Use
Permit was approved as required in the I -1 Zoning District. The petitioner
submitted this Conditional Use Permit application on September 29, 1992.
Notice of this Public Hearing has been published in the Official City
Newspaper, and all property owners within 500 feet have been notified.
PRIMARY ISSUES AND ANALYSIS:
1. The letter sent to the petitioner on September 2, 1992 notifying him of
the zoning violation required that action be taken within 15 days to
correct the situation. This application is in response to that letter.
The application was received on September 29, 1992. As of October 27,
1992, the outside storage of boats and semi - trailers has not been removed
from the site. A small group of pallets are also still stored on the
site.
2. The petitioner is requesting approval of a Conditional Use Permit for the
outside storage of semi - trailers and boats for various companies that have

leased space within the building. A total of 5 existing parking spaces
will be lost to the site to accommodte the storage of these semi- trailers
and boats. The petitioner has not included the pallets in the request for
outside storage. He indicated that the pallets are removed from the site
at the end of each month. The outside storage is not proposed to be
centralized in one part of the parking lot but is scattered throughout the
lot.
3. The petitioner has stated that some of the tenants of the building need
additional storage area for their businesses. Instead of obtaining
building space, the tenants are using semi - trailers to provide the
additional storage area.
4. The Zoning Ordinance states that all outside storage shall be screened
from adjacent property and City right -of -way. The City Council does have
the authority to waive this requirement. The petitioner has requested
that this screening requirement be waived. The outside storage is visible
from the properties to the north and east as well as from 28th Avenue
North.
5. Before any Conditional Use Permit may be granted the Planning Commission
must review the request for compliance with the standards set forth in
Section 9, Subdivision A, Paragraph 2a. of the Zoning Ordinance. Attached
is the Zoning Ordinance citation and the petitioner's response.
PLANNING STAFF COMMENTS:
1. Staff finds that the request to waive the screening requirements does not
meet the intent of the Zoning Ordinance. The purpose of the waiver
provision is to account for storage not otherwise visible to adjoining
properties or the public.
2. The approved Site Plan for this facility required 93 parking spaces. This
proposal would eliminate 5 of those parking spaces without providing
replacement parking. Staff finds that this use would create a zoning
violation by reducing the number of parking spaces below zoning code
requirements.
3. Although the petitioner has indicated that the pallets are removed at the
end of the month, they are stored outside and are subject to the Zoning
Ordinance requirements on outside storage.
4. Staff finds that the proposed outside storage of vehicles and pallets does
not meet the Conditional Use Permit criteria.
5. Current City policy has been to discourage the use of semi - trailers for
product" storage for any significant length of time. Staff is concerned
that approval of this request for permanent storage in trailers will
result in a precedent for the use of semi - trailers for storage purposes.
6. The proposal if approved, would not promote or enhance the general welfare
and will be injurious to use and enjoyment of surrounding property since
screening has not been provided.

7. Due to the location of the proposed outside storage, screening
requirements could result in the screening of the entire parking lot.
8. We have provided draft resolutions for denial, consistent with our
findings; and, for a proval as re ted.

OUTSIDE STORAGE LOCATED AT 14910 -28TH AVENUE NORTH (92092)
WHEREAS, Benson and Orth Associates, Inc. has requested a Conditional Use
Permit for outside storage for property located at 14910 -28th Avenue North;
and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Benson and Orth Associates, Inc. for outside storage for property located at
14910 -28th Avenue North, subject to the following conditions:
1. The permit is subject to all applicable codes, regulations and
Ordinances, and violation thereof shall be grounds for revocation.
2. The permit is issued to Benson and Orth Associates, Inc. as operator of
the facility and shall not be transferable.
3. The site shall be maintained in a sanitary manner.
4. Any signage shall conform with the City Ordinance standards.
5. There shall be no signage allowed on the trailers stored at this site.
6. This Conditional Use Permit is for the outside storage of 5 semi-
trailers, boat trailers and pallets as identified on the Site Plan dated
September 29, 1992.
7. A maximum of 300 gallons of hydraulic oil storage is permitted.
8. The storage of hazardous materials in the semi - trailers is prohibited.
DENYING CONDITIONAL USE PERMIT FOR BENSON AND ORTH ASSOCIATES, INC. FOR
OUTSIDE STORAGE LOCATED AT 14910 -28TH AVENUE NORTH (92092)
WHEREAS, Benson and Orth Associates, Inc. has requested a Conditional Use
Permit for outside storage for property located at 14910 -28th Avenue North;
and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does deny the request by Benson

1. We have requested that the screening requirement of the
ordinance be waved in that the outside storage consists of
storage trailers (3) and trailered boats (2). These units are
consistant with those items stored on commercially zoned land.
2. These units are well maintained, do not contain hazardous,
toxic or flamable materials, and their security is monitored by
the individual permittees thus resulting in no threat to the
general public.
3. The adjacent properties are all commercial zoned and the
outside storage we are requesting is consistant with that of
commercial zoned property. All storage trailers will be parked

because we currently have a semi - trailer parked on the premises.
The trailer is used to store construction materihls such as plywood,
doors, hardware, prbJeet :signs, $man tools and transits. It contains
nothing toxic, hazardous or flammable. We propose that we spot the
trailer adjacent to another one on site behind the 14910B unit.
We respectfully request that you waive the scre4iinf requirement.
We manage the building for the owner, „Circle S "tar Distribution
Center. Our tenants have fully cooperated in improving the
appearance of the property.

This is in reply to your letter of October 14, 1992, regarding outside storage

The trailer at Rotation Engineering's location is used to store overflow parts
and steel materials. None of the items are flamable or hazardous.
The use of the trailer is a short -term solution to a peak manufacturing load
problem. We are currently studying long -term solutions for our space require-
ments such as relocation, expansion, etc.

Permit to allow an encroachment of an enclosed porch to
within 16 feet of the property line.

BACKGROUND:
On September 20, 1976, the City Council, by Resolution 76 -531 approved a RPUD
Concept Plan for the Schmidt Lake Woods Development.
On January 3, 1977, the City Council, by Resolution 77 -9 approved a
Residential Planned Unit Development Preliminary Plan /Preliminary Plat and
Conditional Use Permit for the Schmidt Lake Woods Development.
On May 1, 1978, the City Council, by Resolution 78 -251 approved a Final Plat
and Development Contract for the Schmidt Lake Woods 3rd Addition.
Notice of this Public Hearing has been published in the Official City
Newspaper, and all property owners within 500 feet have been notified.
PRIMARY ISSUES AND ANALYSIS:
1. The Residential Planned Unit Development Plan for the Schmidt Lake Woods
3rd Addition requires a 25 foot setback for all rear yards. The proposed
3- season porch will be located 16 feet from the rear property line.
2. The adjoining lot to the west (adjacent to the proposed addition) is
oriented with a side yard abutting the rear yard of this property. The
side yard setback on the adjacent lot is 10 feet. This request would
result in a 26 foot setback between structures. The proposed enclosed
porch would face the garage side of the house to the west.
3. The Planning Commission is directed by the Zoning Ordinance to consider
any amendment to the Planned Unit Development Plan and Conditional Use
Permit within the context of the Planned Unit Development criteria
addressing compatibility with the purpose of the Planned Unit Development
ordinance; and the internal organization of the site. A copy of the
Conditional Use Permit criteria is attached together with the petitioner's
response.

4. The petitioner is requesting this PUD amendment to allow for the placement
of a 13 foot by 14 foot 3- season porch in the location where an existing
12 foot by 12 foot deck is located. The Zoning Ordinance does permit
decks to encroach 6 feet beyond the required building setback line.
Therefore, the pre- existing deck did not violate Zoning Ordinance
standards.
PLANNING STAFF COMMENTS:
1. Staff finds that the proposal to build a 3- season porch is responsive to
the Conditional Use Permit criteria including impact on the adjacent
property. The adjacent property has been built to the setback line with
the garage side of the house.
2. The addition of the enclosed porch will not increase the lot coverage
beyond the 20 percent maximum allowed by the Zoning Ordinance for this
lot.
3. We have provided resolutions for approval, consistent with our findings;

WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
William Condon for an Amendment to the Planned Unit Development Plan and
Conditional Use Permit to allow the construction of a 3- season porch for
property located at 5035 Evergreen Lane North, subject to the following
conditions:
1. No other amendments or variances are granted or implied.
2. All applicable requirements of the City and State Building Codes shall
be implemented and enforced; no Code requirements are waived by this
approval.
3. The granting of the Permit is responsive to criteria of the Zoning
Ordinance for Conditional Use Permits and PUD Plans.
4. The size of the 3- season porch shall be 10 by 14 feet.
5. The 3- season porch shall be setback 16 feet from the rear property line.

BACKGROUND:
On December 21, 1981, the City Council, by Resolution 81 -842 approved a Site
Plan for a 24,763 square foot warehouse building.
Notice of this Public Hearing has been published in the Official City
Newspaper and all property owners within 500 feet have been notified.
PRIMARY ISSUES AND ANALYSIS:
1. The petitioner is requesting approval of incidental retail sales related
to the Twin City Beekeeping Supply, Inc. which proposes to occupy 5,745
feet in an existing building. The retail sales will occupy will occupy
1,300 square feet or 23 percent of the Twin City Beekeeping Supply lease
space. The hours of operation at the retail portion are proposed to be
from Noon to 6:00 p.m., Tuesday through Friday; and, 9:00 a.m. to 5:00
p.m. on Saturday. The petitioner has indicated that they expect an
average of 10 customers per 8 hour day in this facility.
2. The Zoning Ordinance directs the Planning Commission to consider a
Conditional Use Permit in terms of the criteria found in Section 9,
Subdivision A, Paragraph 2a. We have attached a copy of the referenced
citation together with the petitioner's narrative.
3. The principal concern for granting this request is whether or not the
proposed use is incidental to the principal use of this lease space. The
petitioner has addressed that issue in his narrative.
PLANNING STAFF COMMENTS:
1. Staff finds that the requested Conditional Use Permit for incidental
retail sales meets the Conditional Use Permit criteria for incidental
retail sales.

customers per day would frequent this facility, additional parking spaces
for this use, above what has already been provided, is not required.

Twin City Beekeeping Supply, Inc. (T.C.B.S.) intends to use
the proposed space to fulfill two basic needs.
The first, candle manufacturing. The warehouse space will
be used in the complete process of manufacturing candles.
The second, beekeeping supply and candle making supply
showroom. The office space will be used as an area for
prospective customers to select the items that they wish to
purchase. All stock will be kept in the forward part of the
warehouse space to fill orders.
Based on the past twelve years that T.C.B.S. has been open,
an average of ten customers per eight hour day enter its
showroom. This minimal amount of traffic should not
adversely affect traffic or the surrounding community.
Based on the business of T.C.B.S., the environment and
surrounding businesses would not be adversely affected by
its operations. T.C.B.S. also supports efforts to keep the
environment clean.

Conditional Use Permit Standards - Section 9 Subdivision A
1) Since the retail aspect of Twin City Beekeeping
Supply, Inc. (TCB) is such a small part of its business, the
low flow of traffic coming to TCB will have no effect on the
Comprehensive Plan. Even though this area is zoned for
industrial purposes in the Comprehensive Plan, - the addition
of TCB will not cause problems. Retail hours of operation
would be noon - 6 pm Tuesday thru Friday and 9 an - 5 pm on
Saturday. The average customer count on a weekday is 10 and
on Saturdays it is 14. These counts are based on record
keeping of the number of customers over the past nine years.
This small amount of retail traffic should not disturb the
other businesses in the area.
2) The operation of this permit shall promote the general
welfare of the public by offering a few part time jobs and
by giving local residents the opportunity to learn how to
hand -make natural candles. Since TCB uses only natural
products for its candle production, there would be no
detrimental effect on general public health, safety, morals
or comfort.
3) With a low amount of retail traffic and a minor amount
of workers, other property owners should not even notice the
difference in traffic or use of their spaces. There would
be no cause for the operation of TCB in the area to decrease
any property values.
4) Since the location is already established, the normal
development and improvement of the surrounding property
would not be impeded.
5) There are adequate parking spaces and good ingress and
egress areas to eliminate any traffic worries. No parking
in the streets would be necessary nor would any abnormal
parking procedures be needed. The parking spaces and
ingress and egress areas are marked on the maps to eliminate
any questions about traffic congestion problems.
6) Granting TCB the conditional use shall conform to any
of the applicable regulations of the district in which it is
located.
