HomeMy WebLinkAboutCity Council Resolution 2018-297 C ITY OF P LYMOUTH R ESOLUTION N O. 2018-297 R ESOLUTION A PPROVING A S ITE P LAN A MENDMENT AND V ARIANCE FOR C OMLINK M IDWEST, LLC FOR A P OROUS P AVEMENT A REA AND F ENCE AT 15405 M EDINA R OAD (2018023) WHEREAS, Comlink Midwest, LLC has requested approval of a site plan amendment to allow installation of a roughly 12,300 square-foot porous paved area along the south side of the existing building for additional outdoor storage, and a variance for eight-foot fencing in the front yard on the property presently legally described as follows: LOT 1, BLOCK 2, VOLP INDUSTRIAL PARK, HENNEPIN COUNTY, MINNESOTA. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Comlink Midwest, LLC for a site plan amendment to allow installation of a roughly 12,300 square-foot porous paved area along the south side of the existing building for additional outdoor storage, and a variance for eight-foot fencing in the front yard, subject to the following conditions: 1. A site plan amendment is approved to allow installation of a roughly 12,300 square-foot porous paved area south of the existing building and five-foot concrete apron along the south side of the building, and related improvements, and the related administrative permit for an outdoor storage area is hereby approved, in accordance with the application and plans received by the city on March 7, 2018, and additional information received April 2, 2018, and June 26, 2018, except as amended by this resolution. 2. A variance is approved to allow a portion of an eight-foot fence to be located in the front yard and encroach up to 25 feet from the front property line where 50 feet is required, in accordance with the application and plans received by the city on March 7, 2018, and additional information received April 2, 2018, and June 26, 2018, except as amended by this resolution. The variance is approved with the finding that all variance standards are met. 3. A separate building permit is required prior to the installation of the eight-foot fence. 4. A separate grading permit is required prior to commencement of the project. Resolution 2018-297 File 2018023 Page 2 5. Prior to issuance of any permits, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable City code, zoning ordinance, and engineering guidelines: a. Execute a site improvement performance agreement and submit a financial guarantee pursuant to section 21045.10 of the zoning ordinance. b. Obtain any required permits from the watershed district. c. Obtain approval of the stormwater plans. d. Obtain City approval of final construction plans. e. Revise the plans to include the boundaries of the delineated wetland and show any additional bituminous surface at least 15 feet from the delineated wetland. f. Provide a plan identifying materials stored and storage configuration of the outdoor storage area as approved by the fire inspector. g. Submit gate opening operation details as approved by the fire inspector. 6. No vehicles or gas-operated equipment shall be stored on the porous pavement portion of the outdoor storage area. 7. Silt fence shall be installed prior to any construction on the site. 8. Standard Conditions: a. Any exterior lighting shall comply with section 21105 of the zoning ordinance and shall receive electrical permits. b. Any signage shall comply with section 21155 of the zoning ordinance and shall receive sign permits if required. c. Compliance with City’s landscaping regulations. d. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. e. The site plan and variance shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under sections 21045.09 and 21030.06, respectively, of the zoning ordinance.
