R ESOLUTION N O. 2018-290
R ESOLUTION A PPROVING R EQUEST FOR P AYMENT N O. 4 AND F INAL
P ONDEROSA S TREET R ECONSTRUCTION (16008)
WHEREAS, the City of Plymouth as the owner and New Look Contracting, Inc. as the
contractor, have entered into an agreement for the Ponderosa Street Reconstruction Project.
Said agreement was approved by the City Council on April 26, 2016; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $1,233,347.90. The amount earned of
$1,237,851.00 less the $48,000.00 in liquidated damages is $1,189,851.00 and is
herewith approved. The final amount is $43,496.90 below the original contract
amount.
2. That the work performed by the contractor for the Ponderosa Street
Reconstruction Project and certified to the Council by the engineer as acceptable,
being the same, is hereby released from the contract except as to the conditions
of the performance bond, any and all legal rights of the owner, required
guarantees and correction of faulty work after final payment.
3. Request for Payment No. 4 and Final in the amount of $61,892.55 to New Look
Contracting, Inc. for the Ponderosa Street Reconstruction Project is hereby
approved and the Administrative Services Director is hereby authorized and
directed to pay the same forthwith.
4. Funding for this project will be from the following sources: assessments in the
amount of $159,582.24, the Street Reconstruction Fund in the amount of
$869,924.36, the Sewer Fund in the amount of $4,427.50, the Water Fund in the
amount of $344,168.55, the Water Resources Fund in the amount of $25,476.00
and Minnehaha Creek Watershed in the amount of $12,750.00.
APPROVED by the City Council on this 28th day of August, 2018.
