R ESOLUTION N O. 2018-289
R ESOLUTION A PPROVING C HANGE O RDER N. 1 AND P AYMENT N O. 3 AND F INAL
FOR THE 2018 P OND M AINTENANCE P ROJECT (WR189001)
WHEREAS, the City of Plymouth as the owner and New Look Contracting, Inc. as the
contractor, have entered into an agreement for the 2018 Pond Maintenance Project, City
Project No. WR189001, said agreement was approved by the City Council on January 9, 2018;
and
WHEREAS, Change Order No. 1 is for the removal and replacement of storm sewer pipe
and repair of a bituminous trail; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. Change Order No. 1 in the amount of $6,673.00 is approved.
2. The revised contract amount is $76,198.00 and that the value of the work to date is
$77,661.90 and is approved. The final amount earned is $1,463.90 above the revised
contract amount.
3. That the work performed by the contractor for the 2018 Pond Maintenance Project
and certified to the City Council by the engineer as acceptable, being the same, is
released from the contract except as to the conditions of the performance bond, any
and all legal rights of the owner, required guarantees, and correction of faulty work
after final payment.
4. Request for Payment No. 3 and Final in the amount of $10,222.44 to New Look
Contracting, Inc. for the 2018 Pond Maintenance Project is approved and the
Administrative Services Director is authorized and directed to pay the same forthwith.
5. Funding for this project will be through the Water Resources Fund in the amount of
$81,545.00.
