R ESOLUTION N O. 2018-287
R ESOLUTION A PPROVING R EQUEST FOR P AYMENT N O. 11 AND F INAL FOR
V ICKSBURG L ANE R ECONSTRUCTION AND E XPANSION P ROJECT (16001)
WHEREAS, the City of Plymouth as the owner, and Eureka Construction, Inc. as the contractor,
have entered into an agreement for the Vicksburg Lane Reconstruction and Expansion Project. Said
agreement was approved by the City Council on February 23, 2016; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final
request for payment.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $11,880,322.60 with additional approved change
orders in the amount of $175,956.56 for a revised contract amount of $12,056,279.16.
The value of the work to date is $12,247,537.74 and is approved. The final contract
amount is $264,182.18 or 1.6% above the revised contract amount.
2. That the work performed by the contractor for the Vicksburg Lane Reconstruction and
Expansion Project and certified to the Council by the engineer as acceptable, being the
same, is released from the contract except as to the conditions of the performance bond,
any and all legal rights of the owner, required guarantees and correction of faulty work
after final payment.
3. Request for Payment No. 11 and Final in the amount of $264,182.18 to Eureka
Construction, Inc. for the Vicksburg Lane Reconstruction and Expansion Project is
approved and the Administrative Services Director is authorized and directed to pay the
same forthwith.
4. Funding for this project will be from the following sources: the Street Reconstruction Fund
in the amount of $9,843,456.20, the Park Dedication Fund in the amount of
$1,700,793.22, State Bonding Funds in the amount of $4,700,000.00, and Canadian Pacific
Railway in the amount of $250,000.00.
