FOR “O AKVIEW W OODS” (2018027F) WHEREAS, LDK Builders Inc. has requested approval of a final plat for “Oakview Woods” for two single-family lots; and WHEREAS, the property is presently legally described as: That part of the Northwest Quarter of the Southwest Quarter of Section 26, Township 118 North, Range 22 West of the 5th principal meridian as hereinafter described to-wit: Beginning at the southwest comer of said Northwest Quarter of the Southwest Quarter of Section 26 and running easterly along the South line of said Northwest .Quarter of the Southwest Quarter a distance of 649.2 feet to an iron monument, thence Northerly and parallel with the West line of said Northwest Quarter of the Southwest Quarter a distance of 627.5 feet which point shall be the point of beginning of the tract of land to be hereinafter described; thence continuing northerly and parallel with the said West line of the Northwest Quarter of the Southwest Quarter a distance of 335.5 feet; thence westerly a distance of 172.6 feet; thence southerly and parallel with the West section line of said Northwest Quarter of the Southwest Quarter a distance of 112.0 feet; thence West a distance of 152.0 feet, thence South and parallel with the West line of said Northwest Quarter of Southwest Quarter a distance of 223.5 feet: thence easterly a distance of 324.6 feet to the point of beginning except the North 112 feet thereof. Subject to an easement over the West 15 feet of said tract for use as a road to be constructed through this and adjoining properties; Subject to a specific highway easement in favor of the County of Hennepin, State of Minnesota, through a portion of the Northwest 1/4 of the Southwest 1/4 of Section 26, Township 118, Range 22 as contained in a deed thereof appearing of record in book 1052 of deeds at page 219, Hennepin County, Minnesota; and NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by LDK Builders Inc. for a final plat for Oakview Woods; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. A final plat is approved to allow the property to be subdivided into two lots for single-family homes, in accordance with the plans received by the City on June 22, 2018 and additional information on June 29 and July 2, 2018, except as may be amended by this resolution. Prior to commencement of site development including grading operations, the Developer shall install and request inspection of tree protection fencing and silt fencing. 3. Prior to recording the final plat, the developer shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Execute the required site improvement performance agreement and provide the related financial guarantees and fees. The agreement shall cover, but is not limited to, requirements for grading, drainage, storm water management, and erosion control improvements, as well as for setting of iron monuments. b. Receive City approval of final construction plans. c. Pay the park dedication cash fee in lieu of land dedication for two new dwelling units, in accordance with the dedication ordinance in effect at the time of filing for the final plat. d. Revise the plan to remove the rain garden. A soil amendment should be used instead. e. Verify that the existing services are located in front of each lot. f. Revise the tree preservation plan to include the two front yard trees per lot. g. Receive city approval of final construction plans. h. Receive Bassett Creek Watershed approval. 4. Prior to issuance of building permits, the applicant shall submit a survey indicating: a. A minimum of two front yard trees to be preserved or planted. b. Silt fence and tree preservation fencing installed consistent with city code. c. All structures on the property demolished. 5. No building permits shall be issued for the second home until the final plat, and development contract are filed and recorded with Hennepin County and proof of recording is submitted to the city and public infrastructure is provided as specified in the development contract. 6. The sidewalk requirement is waived because there are no sidewalks in the area. 7. Standard Conditions: a. All retaining walls over four feet shall require issuance of a building permit and a three-foot fence installed on top of the wall. b. The homes proposed on the lots shall be consistent with the RSF-1 zoning district. No variances are approved or implied. c. Compliance with the city’s tree preservation regulations. d. No trees shall be planted in the public right-of-way. e. No trees shall be planted in drainage and utility easements containing storm sewer or sanitary sewer pipes. f. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 512 of City Code.
