HomeMy WebLinkAboutCity Council Resolution 2018-249 C ITY OF P LYMOUTH R ESOLUTION N O. 2018-249 R ESOLUTION A PPROVING A P RELIMINARY P LAT FOR “G REENWAY N ORTH” FOR P ROPERTY L OCATED AT 18405, 18515, AND 18535 C OUNTY R OAD 47, 6035 T ROY L ANE, AND 5945 T ROY L ANE (2018033) WHEREAS, Pulte Homes of Minnesota has requested approval of a preliminary plat for the roughly 24-acre parcel presently legally described as: That part of the East 1/2 of the Northwest 1/4 of Section 6, Township 118, Range 22, Hennepin County, Minnesota, described as follows: Commencing at a point on the West line of said East 1/2 of the Northwest 1/4 distant 1120.2 feet South from the Northwest corner thereof; thence at a right angle bearing East 275.0 feet; thence South 77 degrees 30 minutes East a distance of 604.85 feet to the actual point of beginning; thence continuing South 77 degrees 30 minutes East, a distance of 455.21 feet, more or less, to the East line of said East 1/2 of the Northwest 1/4; thence Southerly along said East line 395.5 feet, more or less, to its intersection with a line drawn parallel to and 921.5 feet North of the South line of said East 1/2 of the Northwest 1/4; thence Westerly parallel with said South line to said West line; thence North along said West line to a point 302.67 feet from the point of commencing; thence at a right angle bearing East distant 812.17 feet, more or less, to its intersection with a line drawn South 17 degrees 15 minutes West from the point of beginning; thence North 17 degrees 15 minutes East a distance of 179.85 feet, more or less, to the point of beginning, Hennepin County, Minnesota. (Abstract Property) WHEREAS, the Planning Commission has reviewed said request for a preliminary plat at a duly called public hearing and recommends approval; and, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Pulte Homes of Minnesota for a preliminary plat for “Greenway North”, subject to the following conditions: 1. A preliminary plat is approved to allow the property to be subdivided into 20 lots for single- family homes and 103 lots for townhomes, in accordance with the application and plans received by the City on April 26, 2018 except as may be amended by this resolution. 2. Approval of the preliminary plat is contingent upon City Council approval of the rezoning of the site to RSF-3 and RMF-2. 3. Prior to release of the final plat for recording, the applicant shall: 1) receive City approval of final construction and storm water plans; 2) execute a development contract and submit related fees and financial guarantees; 3) demolish existing structures on the property; and 4) pay the park dedication cash fee in lieu of land dedication for 123 new dwelling units, in accordance with the dedication ordinance in effect at the time of filing for the final plat. 4. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Submit HOA documents or covenants that include the following: 1. Assigning maintenance of common improvements including wetland buffer, wetland buffer monuments, sidewalks, retaining walls, mailboxes, subdivision signs, and other common elements. 2. Disclosure that roads stubbed to the west and south will eventually get extended when development is proposed. b. Submit executed, 10-foot trail easement adjacent to the right-of-way for County Road 47. c. Submit executed, 10-foot trail easement adjacent to the right-of-way for the west side of th Troy Lane from County Road 47 south to 59 Avenue. d. Pay for or agree to be assessed for sewer and water area charges and watermain lateral special assessment. e. Submit an executed, temporary turn-around easements. f. Revise the plans to meet storm water requirements. g. Revise the plans to meet fire code requirements as follows: 1. Relocate hydrants to approved locations on all streets. 2. Approved turnarounds are required on all dead end streets exceeding 150 feet. The turnarounds shall not encroach onto developed lots. 3. An approved looped water main system through the entire development is required. 4. Submit fire flow calculations and the structure square footage for the largest structure likely to be constructed in the subdivision, including all portions of the building under the roof. 5. All townhouses shall be protected by an approved fire sprinkler system. h. Revise the plans as follows: 1) Provide a road connection from Greenway North to the west plat boundary that will intersect with road ‘B’. 2) Lot 40, Block 2 and Lot 46, Block 3 overlap the driveway easement. 3) Encroachment agreements will be required for retaining walls in a drainage and utility easement. 4) Left and right turn lanes will be required on County Road 47. 5) Remove all existing driveways from County Road 47. 6) Storm pipes between buildings need minimum of 10 feet each side as drainage and utility easements. 7) Explain how wetland 2 is draining before and after the proposed project. 8) Assessments for the proposed 2018 Troy Lane street reconstruction following the City’s current assessment policy will be considered for the development. The assessment amount will be determined at the time of final plat approval. 9) Provide MIDS calculator for volume control documentation. 10) Explain why existing area used to calculate rate control is 186.880 and the proposed condition is 164.618. Existing and proposed acreage should be the same to properly document rate control has been met. 11) Untreated discharges directly to wetlands is prohibited. 12) Outlets on existing wetland basins shall be placed 6 inches below the wetland boundary line. 13) Wetland buffers must comply with required minimums and maximums as set forth in the City’s zoning ordinance. 14) Show Wetland 4 and wetland buffer. 5. Obtain encroachment agreements for any monument signage and any retaining walls. 6. No retaining walls are permitted in trail easements. 7. No new driveway access to County Road 47 or Troy Lane shall be permitted. 8. Obtain all required Hennepin County right-of-way construction permits. 9. Obtain Elm Creek Watershed approval. 10. Obtain NPDES permit. 11. Obtain MDH, MPCA & MCES permits. 12. Provide sod, irrigation and landscaping within the City-owned parcel west of Troy Lane. 13. Incorporate the City-owned parcel west of Troy Lane into the development to facilitate increased spacing between townhome units. 14. Provide sod between townhome driveways instead of rock. 15. Prior to the issuance of a building permit, the applicant shall submit a survey indicating: a. A minimum of two front yard trees to be preserved or planted for the single family home lots. b. Silt fence and tree preservation fencing installed consistent with city code. c. For lots abutting the wetland or pond, the lowest floor elevation shall be at least two feet higher than the high water elevation for the wetland or pond. 16. Standard Conditions: a. No building permits shall be issued until proof of recording is submitted for the final plat, easements, and other recordable documents and the streets (including curb and gutter installation) needed for access to lots where permits are requested are paved with the first lift of asphalt, and the sewer and water service utilities are installed and approved by the city engineer/designee. b. Development standards and setbacks for the single family portion of the plat shall comply with the RSF-3 zoning standards. No variances are granted or implied. c. Development standards and setbacks for the townhome portion of the plat shall comply with the RMF-2 zoning standards. No variances are granted or implied. d. All retaining walls over four feet shall require issuance of a building permit and a three- foot fence installed on top of the wall. e. Driveways shall be set back a minimum of 40 feet from intersections as measured from the intersections of property lines. f. Compliance with the City’s tree preservation regulations. g. No trees shall be planted in the public right-of-way. h. Signs shall require a separate permit and comply with section 21155 of the zoning ordinance. i. Removal of all hazardous trees from the property at the owner's expense. j. This approval shall expire one year after the date of approval, unless the applicant has submitted a complete final plat application, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under section 510 of city code. th ADOPTED by the City Council on this 26 day of June, 2018.
