R ESOLUTION N O. 2018-244
R ESOLUTION A PPROVING THE V ACATION OF T EMPORARY C UL-D E-S AC,
D RIVEWAY AND S NOW P LOW AND U TILITY E ASEMENTS WITHIN P LYMOUTH R ESERVE
WHEREAS, a public hearing with respect to said vacation was scheduled for June 26, 2018, in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to
the meeting of June 26, 2018; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail;
and
WHEREAS, the Council held a public hearing on June 26, 2018 to inform any and all interested
parties relevant to the vacation of Temporary Cul-De-Sac, Driveway and Snow Plow, and Utility
Easements within Plymouth Reserve; and
WHEREAS, it was determined by the City Council that said Temporary Cul-De-Sac, Driveway and
Snow Plow, and Utility Easements were not needed for Public purposes.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the following Temporary Cul-De-Sac, Driveway and Snow Plow and Utility Easements
be vacated:
PARCEL DESCRIPTION:

That part of the Northwest Quarter of Section 9, Township 118 North, Range 22 West of the 5
Principal Meridian, Hennepin County, Minnesota, described as follows: Commencing at the
Northeast corner of said Northwest Quarter; thence on an assumed bearing of North 89
degrees 33 minutes 19 seconds West along the north line of said Northwest Quarter a distance
of 1585 feet to the point of beginning of the land to be described; thence North 89 degrees 33
minutes 19 seconds West along said North line a distance of 1019.07 feet to the Northwest
corner of said Northwest Quarter; thence Southerly along the west line of said Northwst
Quarter to its intersection with a line 60 feet north of, measured radial to, and parallel with the
Northerly right-of-way line of the Soo Line Railroad; thence easterly and southeasterly along
said parallel line to its intersection with a line bearing South 0 degrees 26 minutes 41 seconds
West from the point of beginning; thence North 0 degrees 26 minutes 41 seconds East a
distance of 488.29 feet to the point of beginning, according to the United States Government
Survey thereof and situate in Hennepin County, Minnesota.
EASEMENT DESCRIPTIONS:
An easement for a temporary Cul-De-Sac over, under and across the North 90.00 feet of the East
90.00 of the above described parcel: (Per Doc. No. A9819165)
And,
A 12 foot wide driveway and snow plow easement over, under across that part of the above
described parcel: (Per Doc. No. A10299770)
The centerline of said easement is described as commencing at said point of beginning of the
land described above; thence North 89 degrees 33 minutes 19 seconds West along the north
line of said Northwest Quarter, a distance of 45.81 feet to the point of beginning of the
centerline to be described; thence South 02 degrees 15 minutes 30 seconds West, a distance of
45.91 feet; thence southwesterly 25.07 feet along a tangential curve concave to the northwest
which has a radius of 30.84 feet and a central angle of 46 degrees 34 minutes 26 seconds to a
point of reverse curvature; thence southerly 25.07 feet along a curve concave to the southeast
which has a radius of 30.84 feet and a central angle of 46 degrees 34 minutes 26 seconds;
thence South 02 degrees 15 minutes 30 seconds West tangential to said curve, a distance of
25.09 feet; thence southerly 45.59 feet along a tangential curve concave to the east which has a
radius of 200.00 feet and a central angle of 13 degrees 03 minutes 34 seconds; thence South 10
degrees 48 minutes 05 seconds East tangential to said curve, a distance of 36.06 feet; thence
southerly 89.72 feet along a tangential curve concave to the west which has a radius of 200.00
feet and a central angle of 25 degrees 42 minutes 07 seconds; thence South 14 degrees 54
minutes 02 seconds West tangential to said curve, a distance of 56.37 feet; thence
southwesterly a distance of 96.87 feet along a tangential curve concave to the northwest having
a radius of 155.22 feet and a central angle of 35 degrees 45 minutes 19 seconds to said line
parallel with and 60.00 feet northerly of the north line of the Soo Line Railroad and there
terminating.
Side lines of said easement are to be shortened or prolonged to terminate at said north line of
said quarter and said line parallel with and 60.00 feet northerly of the north line of the Soo Line
Railroad.
And,
A 20.00 foot wide utility easement over, under and across that part of the parcel as described on
the preceding page: (Per Doc. A9819166)
The centerline of said easement is described as commencing at said point of beginning of the
land as described on the preceding page; thence North 89 degrees 33 minutes 19 seconds West
along said north line a distance of 35.81 feet to the point of beginning of the centerline to be
described; thence South 45 degrees 33 minutes 18 seconds West a distance of 168.90 feet;
thence South 36 degrees 48 minutes30 seconds West a distance of 304.99 feet; thence North 74
degrees 30 minutes 46 seconds West a distance of 240.47 feet; thence North 80 degrees 51
minutes 44 seconds a distance of 112.83 feet; thence North 42 degrees 42 minutes 57 seconds
West a distance of 57.55 feet; thence North 87 degrees 42 minutes 45 seconds West a distance
of 167.75 feet; thence South 81 degrees 35 minutes 54 seconds West a distance of 10.17 feet to
the centerline of the existing drainage and utility easement crossing said property and there
terminating.
The sidelines of said easement are to be prolonged or shortened to terminate at said north line
of the Northwest Quarter.
BE IT FURTHER RESOLVED, that the recording of the vacation resolution shall be accomplished
with, but prior to the recording of Plymouth Reserve.
BE IT FURTHER RESOLVED that said vacation shall not affect the authority of any person
corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines,
sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or
thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to
maintain, repair, replace, remove, or otherwise attend thereof.
