HomeMy WebLinkAboutCity Council Resolution 2018-233 C ITY OF P LYMOUTH R ESOLUTION N O. 2018-233 R ESOLUTION A PPROVING A C ONDITIONAL U SE P ERMIT FOR NRG R ELIABILITY S OLUTIONS FOR P ROPERTY LOCATED AT 5905 T RENTON L ANE (2018035) WHEREAS, NRG Reliability Solutions has requested approval of a conditional use permit for the construction of two exhaust stacks 56.5 feet in height for two existing generators for the property legally described as follows: Lot 1, Block 2, Bass Creek Business Park Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by NRG Reliability Solutions for a conditional use permit for the construction of two exhaust stacks 56.5 feet in height for two existing generators for property located at 5905 Trenton Lane, subject to the following conditions: 1. A conditional use permit is approved to allow the construction of two exhaust stacks 56.5 feet in height for two existing emergency stand-by generators, in accordance with the application and plans received by the city on May 7, 2018, and additional information on May 16, 2018, except as may be amended by this resolution. 2. The conditional use permit is approved with the finding that all applicable conditional use permit standards are met. 3. Separate building and mechanical permits from the building division are required prior to commencement of the project. 4. The permit is subject to all applicable building and fire codes, and to all city regulations and ordinances. Any violation thereof shall be grounds for revocation. 5. Standard conditions: a. Any signage shall comply with section 21155 of the zoning ordinance and shall receive sign permits if required. b. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. Res. 2018-233 File 2018035 Page 2 c. The conditional use permit shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
