FOR P ROPERTY LOCATED AT 1740 O AKVIEW L ANE (2018027) WHEREAS, LDK Builders Inc. has requested approval of a preliminary plat to create two single family homes in the RSF-1 single family dwelling district for roughly 1.67 acres of land presently legally described as follows: That part of the Northwest Quarter of the Southwest Quarter of Section 26, Township 118 North, Range 22 West of the 5th principal meridian as hereinafter described to-wit: Beginning at the southwest comer of said Northwest Quarter of the Southwest Quarter of Section 26 and running easterly along the South line of said Northwest .Quarter of the Southwest Quarter a distance of 649.2 feet to an iron monument, thence Northerly and parallel with the West line of said Northwest Quarter of the Southwest Quarter a distance of 627.5 feet which point shall be the point of beginning of the tract of land to be hereinafter described; thence continuing northerly and parallel with the said West line of the Northwest Quarter of the Southwest Quarter a distance of 335.5 feet; thence westerly a distance of 172.6 feet; thence southerly and parallel with the West section line of said Northwest Quarter of the Southwest Quarter a distance of 112.0 feet; thence West a distance of 152.0 feet, thence South and parallel with the West line of said Northwest Quarter of Southwest Quarter a distance of 223.5 feet: thence easterly a distance of 324.6 feet to the point of beginning except the North 112 feet thereof. Subject to an easement over the West 15 feet of said tract for use as a road to be constructed through this and adjoining properties; Subject to a specific highway easement in favor of the County of Hennepin, State of Minnesota, through a portion of the Northwest 1/4 of the Southwest 1/4 of Section 26, Township 118, Range 22 as contained in a deed thereof appearing of record in book 1052 of deeds at page 219, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by LDK Builders Inc., for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the property at 1740 Oakview Lane to be subdivided into two-single family lots, in accordance with the development plans received by the city on April 10, 2018, and additional information on April 18, 2018, except as amended by this resolution. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a) Pay the park dedication cash fee in lieu of land dedication for two new dwelling units, in accordance with the dedication ordinance in effect at the time of filing for the final plat. b) Revise the tree preservation plan to include the disturbance zone, the location of required tree protection fencing and the addition of two front yard trees per lot. c) Receive city approval of final construction plans. d) Receive Bassett Creek Watershed approval. e) Receive NPDES permit, if required. f) Demolish of all structures on the property. 2. Sidewalks are not required as part of this development. 3. Prior to demolition of the home, the applicant shall obtain a demolition permit from the building division. 4. Prior to construction of both homes, the applicant shall obtain a building permit from the building division. 5. Prior to issuance of a building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a) File and record the final plat with Hennepin County. b) Install and request inspection of tree protection fencing and silt fencing. c) Obtain the necessary right-of-way permits from the City of Plymouth Engineering Division to allow work in the right-of-way. d) Provide a certificate of survey indicating a minimum of two front yard trees to be planted. e) Show erosion and sediment controls, i.e. silt fence, inlet protections, rock entrance, etc. f) Add proposed lowest opening elevation for both homes. g) Submit disturbed area and new impervious surface calculations. 6. Standard Conditions: a. Silt fence shall be installed prior to any construction. b. Retaining walls over four feet require issuance of a building permit and a minimum three-foot fence installed on top. c. Removal of all hazardous trees at the owner's expense. d. No trees shall be planted in the public right-of-way. e. The preliminary plat shall expire one year after the date of approval, unless the property owner or applicant has applied for final plat approval, or unless the applicant, with the consent of the landowner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
