R ESOLUTION N O. 2018-226
R ESOLUTION A PPROVING R EQUEST FOR P AYMENT N O. 3 AND F INAL
S CHMIDT L AKE S TORM W ATER L IFT S TATION R EHABILITATION (15004)
WHEREAS, the City of Plymouth as the owner and Penn Contracting, Inc. as the
contractor, have entered into an agreement for the Schmidt Lake Storm Water Lift Station
Rehabilitation, City Project No. 15004, said agreement was approved by the City Council on
September 27, 2016; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $286,700.00 and that the value of the work to
date is $281,950.50 and is herewith approved. The final amount is 1.7% below the
original contract amount.
2. That the work performed by the contractor for the Schmidt Lake Storm Water Lift
Station Rehabilitation and certified to the City Council by the engineer as acceptable,
being the same, is released from the contract except as to the conditions of the
performance bond, any and all legal rights of the owner, required guarantees and
correction of faulty work after final payment.
3. Request for Payment No. 3 and Final in the amount of $34,000.50 to Penn
Contracting, Inc. for the Schmidt Lake Storm Water Lift Station Rehabilitation is
approved and the Administrative Services Director is authorized and directed to pay
the same forthwith.
4. Funding for this project will be through the Water Resources Fund in the amount of
$324,243.08.
