HomeMy WebLinkAboutCity Council Resolution 2018-200 C ITY OF P LYMOUTH R ESOLUTION N O. 2018-200 R ESOLUTION A PPROVING S ITE P LAN A MENDMENT FOR M ISTER C AR W ASH LOCATED AT 11318 H IGHWAY 55 (2018 026) WHEREAS, Civil Site Group has requested approval of a site plan amendment to allow building and parking changes at 11318 Highway 55, legally described as follows: That part of the Southeast Quarter of the Northeast Quarter of Section 35, Township 118 North, th Range 22 West of the 5 Principal Meridian, Hennepin County, Minnesota, described as follows: Commencing at a point on the North line of said Southeast Quarter of the Northeast Quarter distant 753.32 feet West of the Northeast corner of said Southeast Quarter of the Northeast Quarter (said North line being assumed to have a bearing of East for purposes of this description); thence South 8 degrees 02 minutes 30 seconds East 113.42 feet more or less to the Northerly right-of-way line of State Trunk Highway No. 55; thence Southeasterly along said Northerly right-of-way line of State Trunk Highway No. 55 a distance of 170 feet to the point of beginning of the property being described; thence Northeasterly on a straight line to the point of intersection with said North line at a point thereon distant 528.32 feet West of said Northeast corner; thence East along said North line 174.33 feet; thence South 15 degrees 35 minutes West a distance of 212.02 feet more or less to said Northerly right-of-way; thence Northwesterly along said Northerly right-of-way line to the point of beginning. AND That part of the Southeast Quarter of the Northeast Quarter of Section 35, Township 118 North, th Range 22 West of the 5 Principal Meridian, Hennepin County, Minnesota, described as follows: Commencing at a point on the North line of said Southeast Quarter of the Northeast Quarter distant 753.32 feet West of the Northeast corner of said Southeast Quarter of the Northeast Quarter (said North line being assumed to have a bearing of East for purposes of this description); thence South 8 degrees 02 minutes 30 seconds East 113.42 feet more or less to the Northerly right-of-way line of State Trunk Highway No. 55; thence Southeasterly along said Northerly right-of-way line of State Trunk Highway No. 55 a distance of 170 feet; thence Northeasterly on a straight line to the point of intersection with said North line of the Southeast Quarter of the Northeast Quarter at a point thereon 225 feet East of the point of beginning; thence West to the point of beginning. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting. Resolution 2018-200 File 2018026 Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Civil Site Group for a site plan amendment for building and parking lot changes at 11318 Highway 55, subject to the following conditions: 1. A site plan amendment is approved to remove the west building and reconfigure the site layout in accordance with the plans received by the City on April 5, 2018 and revised Plan C2.0 received by the City on May 9, 2018, except as may be amended by this resolution. 2. A permit to demolish the west building is required prior to removal of that building. Prior to permit issuance, the applicant shall: a. Provide a financial guarantee for the landscaping. b. Obtain Bassett Creek Watershed review. c. Consolidate the site into one tax parcel. 3. Standard Conditions: a. Compliance with the City’s lighting regulations. b. Compliance with City’s sign regulations. There are presently two freestanding signs on the site, but only one freestanding sign is allowed. As a result, one of the freestanding signs must be removed from the site. c. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. d. The site plan amendment shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under section 21045.09 of the zoning ordinance.
