HomeMy WebLinkAboutCity Council Resolution 2018-198 C ITY OF P LYMOUTH R ESOLUTION N O. 2018-198 ND R ESOLUTION A PPROVING F INAL P LAT FOR “S UMMERS E DGE S OUTH 2 A DDITION” (2017107F) WHEREAS, Summergate Companies, has requested approval of a final plat for “Summers Edge nd South 2 Addition” for forty-five single-family lots; and WHEREAS, the property is presently legally described as: Outlot A, Summers Edge South, Hennepin County, Minnesota And That part of Lot 1, Block 1, Busch Properties South lying West of the Southerly extension of the East line of Lot 1, Block 1, Busch Properties North, Hennepin County, Minnesota. WHEREAS, city staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Summergate Companies, for a final plat for nd Summers Edge South 2 Addition; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. A final plat is approved to allow the property to be subdivided into 45 lots for single-family homes, in accordance with the plans received by the City on April 4, 2018, April 16, 2018 and May 2, 2018 except as may be amended by this resolution. 2. Prior to recording the final plat, the developer shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Execute the development contract and provide the related financial guarantees and fees. b. Pay park dedication in accordance with the terms of the Development Contract. c. Receive City approval of final construction plans. d. Receive a lot line adjustment approval by Hennepin County. Resolution 2018-198 File 2017107F Page 2 e. Receive Elm Creek Watershed approval. f. Receive NPDES permit. g. Receive MPCA, MCES and MDH permits. h. Receive city approval of street easement vacations. i. Revise the plans as follows: a. Update plans with the correct street names and subdivision name. b. Update plans to show Lot 6, Block 3 as one lot. c. Update plat monitoring plan to include correct street names and acreage for the easement located on Lot 6, Block 3. d. Revise with correct lots and drainage and utility easements. th e. Revise to show ditch along Brockton Lane from Medina Road to 40 Avenue in greater detail. f. Provide plans signed by a professional engineer. g. Add and relocate hydrants to approved locations on all streets with a maximum spacing of 400 feet between hydrants. h. Submit fire flow calculations showing the highest elevation hydrant and the last hydrant on Alvarado Place. j. Receive an encroachment agreement for the fence along Brockton and include fence maintenance in the HOA documents. k. If the required sidewalks are not installed when the streets are installed, no building permits shall be issued for lots abutting the future sidewalk unless a separate sidewalk agreement is provided for each affected lot. l. Provide all required easements with correct subdivision name. m. Provide all required easements and agreements, including but not limited to an encroachment agreement where developer-installed retaining walls would lie within drainage and utility easements. n. Submit separate disclosures for the first purchasers indicating that the greenhouses are used year-round and the agricultural use may produce noise, odor or lights related to the growing operation and that the heating method requires the grinding of trees into wood chips. o. Submit an executed, 10-foot trail easement adjacent to the right-of-way for Brockton Lane. p. Submit an executed, 10-foot trail easement adjacent to the right-of-way for Medina Road. q. Lot 6, Block 3 shall include an easement in the favor of the HOA along Medina Road addressing the HOA’s responsibility for the maintenance and replacement of landscaping on the berm. r. The developer is to construct and pay for the trail along Brockton lane at the time the streets are constructed. s. Submit HOA documents or covenants that include the following: 1) Assigning maintenance of common improvements including the wetland buffer, wetland buffer monuments, retaining walls, fence along Brockton Lane, subdivision signs, easement landscaping areas, etc. 2) Disclosure indicating that the nearby greenhouses are used year-round and the agricultural use may produce noise, odor or lights related to the growing operation and that the heating method requires the grinding of trees into wood chips. 3) Disclosure that roads stubbed to the east will eventually get extended when subdivision is proposed. Resolution 2018-198 File 2017107F Page 3 t. Submit the total square footage for the largest home likely to be constructed in the subdivision. Include all areas under the roof, excluding the attic. Based on this information, revise the fire flow calculations as necessary to meet the Fire Code. 3. Prior to commencement of site development including grading operations, the developer shall install and request inspection of tree protection fencing and silt fencing, and shall obtain the required NPDES permit. 4. Prior to issuance of building permits, the applicant shall submit a survey indicating: a. A minimum of two front yard trees to be preserved or planted, and b. Silt fence and tree preservation fencing installed consistent with city code. 5. The developer shall complete grading and installation of any and all required Best Management Practices (BMP’s) for management of drainage and storm water runoff. 6. Standard Conditions: a. No building permits shall be issued until the final plat, deeds, easements, agreements, and HOA documents are filed and recorded with Hennepin County and proof of recording is submitted to the city and public infrastructure is provided as specified in the development contract. b. All retaining walls over four feet shall require issuance of a building permit and a three-foot fence installed on top of the wall. c. The homes proposed on the lots shall be consistent with the RSF-3 zoning district. No variances are approved or implied. d. Compliance with the city’s tree preservation regulations. e. No trees shall be planted in the public right-of-way. f. Signs shall require a separate permit and comply with section 21155 of the zoning ordinance. g. No building permits, including those for a model home, shall be issued until the final plat is recorded with Hennepin County. h. No trees shall be planted in drainage and utility easements containing storm sewer or sanitary sewer pipes. i. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 512 of City Code.
