HomeMy WebLinkAboutCity Council Resolution 2018-182 C ITY OF P LYMOUTH R ESOLUTION N O. 2018-182 R ESOLUTION A PPROVING A S ITE P LAN A MENDMENT, C ONDITIONAL U SE P ERMIT AND V ARIANCE FOR R YAN C OMPANY US, I NC. FOR P ROPERTY LOCATED AT 4090 A NNAPOLIS LANE (2018015) WHEREAS, Ryan Company US, Inc., has requested approval of a site plan amendment, conditional use permit and variance to allow construction of a coffee shop in the C-3 (highway commercial) zoning district for the property presently legally described as follows: TH LOT 2, BLOCK 1, PLYMOUTH BUSINESS CENTER 4 ADDITION, HENNEPIN COUNTY, MINNESOTA. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Ryan Company US, Inc. for a site plan amendment, conditional use permit and variance to allow construction of a coffee shop, subject to the following conditions: 1. A site plan amendment is approved to allow construction of a 2,100 square-foot coffee shop and related site improvements, in accordance with the plans received by the City on February 12 and 16, 2018 and April 10, 2018, except as amended by this resolution. 2. A conditional use permit is approved to allow a drive-through in the B-3 zoning district with the finding that the proposal complies with all applicable conditional use permit standards. 3. A variance is approved to allow a drive-through not screened by an intervening building that is within 300 feet of a residential property, with the finding that the proposal complies with all applicable variance criteria. 4. All signage shall require separate permits and shall be in conformance with the sign regulations in section 21155 of zoning ordinance. 5. The operation shall be responsible for litter control within 300 feet of the premises and litter control is to occur on a daily basis. Trash receptacles must be provided at a convenient location on site to facilitate litter control. 6. The trash enclosure shall be of the same materials as the primary building. 7. A separate demolition permit is required for demolition of any existing buildings on site. 8. A separate building permit is required prior to construction of the project. Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable City code, zoning ordinance, and engineering guidelines: a. Execute a site improvement performance agreement and submit a financial guarantee pursuant to section 21045.10 of the zoning ordinance. b. Obtain the required right-of-way permits from the City of Plymouth engineering division for any work in the Annapolis Lane right-of-way. c. Obtain any required permits from other agencies including, but not limited to MnDOT and the watershed district. d. Obtain City approval of final construction plans. e. Provide exterior lighting fixture details that include the backlight, uplight and glare (B.U.G) ratings, color rendering index (CRI) and correlated color temperature (CCT). f. Revise the plans to meet fire code requirements as follows: g. Identify the post indicator valve location. h. Submit fire apparatus turning radius evaluation using fire truck aerial 11 on the drive aisle between the east property line and the islands on the east side of the property. The evaluation shall prove that the fire apparatus does not encroach into designated parking spaces or come in contact with any objects, i.e. curbs, landscaping or signs or amend site plan to conform with requirement. i. Submit approved cross access easement agreement with the new property owner and the property owner to the east of the site for unobstructed fire access and water supply for both properties in perpetuity. j. Fire hydrants shall be provided in locations to be approved by the fire inspector. k. Provide an approved solenoid valve on the combination fire/domestic water supply line to the building. l. Relocate Fire Department Connection to the southeast corner of the building. m. Revise the plans to meet engineering requirements as follows: n. Remove signage from easements. o. Show all easements. p. No ponds, no raingardens, no sand filters, etc. q. Install a sump catch basin or manhole on the last structure before stormwater leaves site. r. Add project #2018015 to all sheets. s. Include relevant City details in plans. t. Show pavement sections. 10. All construction parking shall be located on-site. 11. Basset Creek Watershed review needed. 12. A stormwater maintenance agreement will be required for the sump structure. 13. All rooftop and mechanical equipment shall be screened as required by section 21130.05 of the zoning ordinance. Resolution 2018-182 File 2018015 Page 3 14. Silt fence shall be installed prior to any grading or construction on the site. 15. Fire lane signage shall be provided in locations to be field identified by the fire inspector. 16. All new and repaired drive aisles and fire lanes shall be constructed to minimum standards and approved by City Fire Inspector. 17. The facility’s public address system shall not be audible from any adjacent residentially zoned or guided property and shall comply with Section 21105.10 of this Chapter. 18. Standard Conditions: a. The applicant shall remove any diseased or hazardous trees. b. The site shall remain in conformance with section 2025 of the City code regarding noise regulations. c. Compliance with the City’s lighting regulations. d. Any signage shall comply with section 21155 of the zoning ordinance and shall receive sign permits if required. e. Compliance with City’s landscaping regulations. f. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. 19. The conditional use permit, site plan amendment and variance shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under sections 21015.07, 21045.09 and 21030.06 respectively, of the zoning ordinance.
