R ESOLUTION N O. 2018-180
R ESOLUTION A PPROVING R EQUEST FOR P AYMENT N O. 3 AND F INAL FOR THE
F LASHING Y ELLOW A RROW S IGNAL P ROJECT P HASE 2 (15008)
WHEREAS, the City of Plymouth as the owner and Killmer Electric Company, Inc. as the
contractor, have entered into an agreement for the Flashing Yellow Arrow Signal Project Phase
2, said agreement was approved by the City Council on April 26, 2016; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $357,760.00 and that the value of the work
to date is $357,760.00 and is approved.
2. That the work performed by the contractor for the Flashing Yellow Arrow Signal
Project Phase 2 and certified to the Council by the engineer as acceptable, being
the same, is released from the contract except as to the conditions of the
performance bond, any and all legal rights of the owner, required guarantees and
correction of faulty work after final payment.
3. Request for Payment No. 3 and Final in the amount of $23,863.50 to Killmer
Electric Company, Inc. for the Flashing Yellow Arrow Signal Project Phase 2 is
approved and the Administrative Services Director is authorized and directed to
pay the same forthwith.
4. Funding for this entire project will be from the Street Reconstruction Fund
(transfer from General Fund Reserves via Resolution 2014-285) for $692,665.00
and Construction Improvement Fund (CON 413) for $396,861.31.
