HomeMy WebLinkAboutCity Council Resolution 2018-178 C ITY OF P LYMOUTH R ESOLUTION N O. 2018-178 R ESOLUTION A PPROVING THE M ODIFIED W ETLAND R EPLACEMENT P LAN FOR H AMPTON H ILLS P HASE I, H AMPTON H ILLS 3 RD A DDITION & H AMPTON H ILLS S OUTH P LATEAU N ½ S ECTION 9 & S ½ S ECTION 4, T118N, R22W WHEREAS, Tradition, LLC proposes to mitigate for wetland impacts associated with the Hampton Hills Phase I, Hampton Hills 3rd Addition, and Hampton Hills South Plateau residential developments; and WHEREAS, the wetland replacement plan for Hampton Hills Phase I and Hampton Hills 3rd Addition was originally approved by the City Council on May 24, 2011; and WHEREAS, the wetland replacement plan for Hampton Hills South Plateau was originally approved on February 28, 2012; and WHEREAS, a modified replacement plan application was prepared replacing wetlands in Hampton Hills Phase I, Hampton Hills 3rd Addition, and Hampton Hills South Plateau at a minimum 2:1 ratio as required by the Wetland Conservation Act (WCA); and WHEREAS, wetland mitigation for impacts associated with all three developments shall be in the form of 77,408 square feet (1.78 acre) of on-site wetland mitigation; and WHEREAS, the replacement plan meets the requirements of the Wetland Conservation Act. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the modified Wetland Replacement Plan application for Hampton Hills Phase I, Hampton Hills 3rd Addition, and Hampton Hills South Plateau is approved and subject to the following conditions: 1. A deed creating a restrictive covenant running with the land for the replacement area must be recorded. The deed shall meet the requirements of the Wetland conservation Act and be submitted to the City for approval before recording and a recorded copy shall be submitted to the City after recording. 2. Required Consent(s) to Replacement Wetlands must be submitted to the City after filing with the County Recorder. APPROVED by the City Council on this 8th day of May, 2018.
