HomeMy WebLinkAboutCity Council Resolution 2018-107 C ITY OF P LYMOUTH R ESOLUTION N O. 2018-107 R ESOLUTION A PPROVING A S ITE P LAN, C ONDITIONAL U SE P ERMIT AND V ARIANCES FOR V IKING D EVELOPMENT, LLC FOR P ROPERTY LOCATED AT 505 S TATE H IGHWAY 169 (2017109) WHEREAS, Viking Development, LLC, has requested approval of a site plan, conditional use permit and variances to allow construction of a preschool building in the B-C (business campus) zoning district for the property presently legally described as follows: That part of Lot 2, Block 1, GROVES OFFICE PARK ANNEX, according to the recorded plat thereof, Hennepin County, Minnesota, described as follows: Beginning at the northeast corner of Lot 2; thence North 89 degrees 35 minutes 18 seconds West (depicted as North 89 degrees 58 minutes 19 seconds West in the plat of GROVES OFFICE PARK ANNEX), assumed bearing, along a north line of said Lot 2, a distance of 322.78 feet; thence South 44 degrees 20 minutes 55 seconds West, a distance of 62.27 feet; thence South 45 degrees 38 minutes 19 seconds East, a distance of 321.27 feet to the southeasterly line of said Lot 2; thence 107.02 feet along said southeasterly line of Lot 2 along a non-tangential curve concave to the northwest having a radius of 512.96 feet, a central angle of 11 degrees 57 minutes 13 seconds, and a chord that bears North 36 degrees 06 minutes 59 seconds East; thence South 59 degrees 51 minutes 38 seconds East along said southeasterly line of Lot 2, not tangent to the last described curve, a distance of 10.00 feet; thence 197.80 feet along said southeasterly line of Lot 2 along a non-tangential curve concave to the northwest to the point of beginning. Said curve having a radius of 522.96 feet, a central angle of 21 degrees 40 minutes 14 seconds and a chord that bears North 19 degrees 18 minutes 15 seconds East. Lot 2, Block 1, GROVES OFFICE PARK ANNEX, according to the recorded plat thereof, Hennepin County, Minnesota, EXCEPT that part described as follows: Beginning at the northeast corner of Lot 2; thence North 89 degrees 35 minutes 18 seconds West (depicted as North 89 degrees 58 minutes 19 seconds West in the plat of GROVES OFFICE PARK ANNEX), assumed bearing, along a north line of said Lot 2, a distance of 322.78 feet; thence South 44 degrees 20 minutes 55 seconds West, a distance of 62.27 feet; thence South 45 degrees 38 minutes 19 seconds East, a distance of 321.27 feet to the southeasterly line of said Lot 2; thence 107.02 feet along said southeasterly line of Lot 2 along a non-tangential curve concave to the northwest having a radius of 512.96 feet, a central angle of 11 degrees 57 minutes 13 seconds, and a chord that bears North 36 degrees 06 minutes 59 seconds East; thence South 59 degrees 51 minutes 38 seconds East along said southeasterly line of Lot 2, not tangent to the last described curve, a distance of 10.00 feet; thence 197.80 feet along said southeasterly line of Lot 2 along a non-tangential curve concave to the northwest to the point of beginning. Said curve having a radius of 522.96 feet, a central angle of 21 degrees 40 minutes 14 seconds and a chord that bears North 19 degrees 18 minutes 15 seconds East. Resolution No. 2018-107 WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Viking Development, LLC, for a site plan, conditional use permit and variances to allow construction of a preschool building, subject to the following conditions: 1. A site plan is approved to allow construction of a two-story, 17,760-square-foot preschool and related site improvements, in accordance with the plans received by the city on November 22 , 2017 and January 5 and 26, 2018, except as amended by this resolution. 2. A conditional use permit is approved to allow a daycare facility in the B-C district with the finding that the proposal complies with all applicable conditional use permit standards. 3. Variances are approved to allow 1) a side-yard building setback of 6 feet to the new lot line where 15 feet is required by the zoning ordinance; and 2) a parking setback of 15 feet in the side yard from the new lot line to the existing parking where 20 feet is required by the zoning ordinance, with the finding that the proposal complies with all applicable variance criteria. 4. Approval of the site plan, conditional use permit and variances is contingent on approval of the preliminary plat. 5. A separate building permit is required prior to construction of the project. 6. Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Execute a site improvement performance agreement and submit a financial guarantee pursuant to section 21045.10 of the zoning ordinance. b. Obtain city approval of final construction plans. c. Submit for city review, execute and record a maintenance agreement for the pervious pavement. d. Provide proof of recording for the final plat and all easements and agreements. e. Obtain any required permits from other agencies including, but not limited to, MnDOT and the Bassett Creek watershed district. f. Revise the site plan to include: 1) ADA sidewalk connection from the new building to the private drive to the north, and 2) protective fencing, which has an anti-ram barrier and is ornamental with a bar across the top such as the Majestic fence by Ameristar, along the private drive adjacent to the outdoor playground area. g. Revise the lighting plan pursuant to section 21105 of the zoning ordinance in conformance to the exterior lighting requirements for the Light Zone 2 (LZ-2). The plan shall include the proposed lumens per square foot of hardscape (maximum 2.5 lumen per square foot of hardscape). h. Provide exterior lighting fixture details that include the backlight, uplight and glare (B.U.G) ratings, color rendering index (CRI) and correlated color temperature (CCT). Resolution No. 2018-107 i. Revise the tree inventory plan to identify the proposed disturbance zone and proposed location and details of the required tree protection fencing. j. Revise the landscaping plan to identify specific tree species location based on the listed plant schedule. k. Revise the plans to meet fire code requirements as follows: 1) Identify the fire department connection and post indicator valve locations. The fire department connection is required in an approved location in the immediate area of the main entrance location. 2) Show additional hydrants as required in approved locations on the final plans. 3) Submit fire flow calculations flowing the two highest elevation hydrants individually and simultaneously to 20 psi residual pressure at each hydrant with the total gpm at each hydrant. 4) Show fire lane signs on the final plans. 5) Show an approved solenoid valve as required on the combination water supply line for fire and domestic use. 6) Provide approved cross easement agreements for unobstructed access and water supply as required for the properties and the property to the north of the site. l. Revise the plans to meet engineering requirements as follows: 1) Add city project number 2017109 to all sheets. 2) Add city details to plans. 3) Provide a breakdown of all new impervious surfaces. 7. All signage shall require separate permits. All signs shall be in conformance with the sign regulations in section 21155 of zoning ordinance. 8. All construction parking shall be located on-site. 9. All rooftop and mechanical equipment shall be screened as required by section 21130.05 of the zoning ordinance. 10. Silt fence shall be installed prior to any grading or construction on the site. 11. Fire lane signage shall be provided in locations to be field identified by the fire inspector. 12. Standard Conditions: a. The applicant shall remove any diseased or hazardous trees. b. The site shall remain in conformance with section 2025 of the city code regarding noise regulations. c. No trees may be planted in the public right-of-way. d. Any retaining wall that exceeds four feet in height shall require a separate building permit and a fence with a minimum height of three feet shall be required on top of the wall. e. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. 13. The conditional use permit, site plan and variances shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the Resolution No. 2018-107 consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21015.07, 21045.09 and 21030.06 respectively, of the zoning ordinance.
