HomeMy WebLinkAboutCity Council Resolution 2018-106 C ITY OF P LYMOUTH R ESOLUTION N O. 2018-106 R ESOLUTION A PPROVING A P RELIMINARY P LAT FOR V IKING D EVELOPMENT, LLC FOR P ROPERTY LOCATED AT 505 S TATE H IGHWAY 169 (2017109) WHEREAS, Viking Development, LLC, has requested approval of a preliminary plat for the roughly 12.35-acre parcel presently legally described as follows: That part of Lot 2, Block 1, GROVES OFFICE PARK ANNEX, according to the recorded plat thereof, Hennepin County, Minnesota, described as follows: Beginning at the northeast corner of Lot 2; thence North 89 degrees 35 minutes 18 seconds West (depicted as North 89 degrees 58 minutes 19 seconds West in the plat of GROVES OFFICE PARK ANNEX), assumed bearing, along a north line of said Lot 2, a distance of 322.78 feet; thence South 44 degrees 20 minutes 55 seconds West, a distance of 62.27 feet; thence South 45 degrees 38 minutes 19 seconds East, a distance of 321.27 feet to the southeasterly line of said Lot 2; thence 107.02 feet along said southeasterly line of Lot 2 along a non-tangential curve concave to the northwest having a radius of 512.96 feet, a central angle of 11 degrees 57 minutes 13 seconds, and a chord that bears North 36 degrees 06 minutes 59 seconds East; thence South 59 degrees 51 minutes 38 seconds East along said southeasterly line of Lot 2, not tangent to the last described curve, a distance of 10.00 feet; thence 197.80 feet along said southeasterly line of Lot 2 along a non-tangential curve concave to the northwest to the point of beginning. Said curve having a radius of 522.96 feet, a central angle of 21 degrees 40 minutes 14 seconds and a chord that bears North 19 degrees 18 minutes 15 seconds East. Lot 2, Block 1, GROVES OFFICE PARK ANNEX, according to the recorded plat thereof, Hennepin County, Minnesota, EXCEPT that part described as follows: Beginning at the northeast corner of Lot 2; thence North 89 degrees 35 minutes 18 seconds West (depicted as North 89 degrees 58 minutes 19 seconds West in the plat of GROVES OFFICE PARK ANNEX), assumed bearing, along a north line of said Lot 2, a distance of 322.78 feet; thence South 44 degrees 20 minutes 55 seconds West, a distance of 62.27 feet; thence South 45 degrees 38 minutes 19 seconds East, a distance of 321.27 feet to the southeasterly line of said Lot 2; thence 107.02 feet along said southeasterly line of Lot 2 along a non-tangential curve concave to the northwest having a radius of 512.96 feet, a central angle of 11 degrees 57 minutes 13 seconds, and a chord that bears North 36 degrees 06 minutes 59 seconds East; thence South 59 degrees 51 minutes 38 seconds East along said southeasterly line of Lot 2, not tangent to the last described curve, a distance of 10.00 feet; thence 197.80 feet along said southeasterly line of Lot 2 along a non-tangential curve concave to the northwest to the point of beginning. Said curve having a radius of 522.96 feet, a central angle of 21 degrees 40 minutes 14 seconds and a chord that bears North 19 degrees 18 minutes 15 seconds East. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. Res. 2018-106 File 2017109 Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Viking Develpment, LLC for a preliminary plat, subject to the following conditions: 1. A preliminary is approved to allow the property located at 505 State Highway 169 to be subdivided to create two lots, in accordance with the application and plans received by the city on November 22, 2017 and January 5 and 26, 2018, except as may be amended by this resolution. 2. Prior to release of the final plat for recording purposes, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Submit private easements regarding cross access, ingress and egress, parking, and utilities and covenants regarding shared maintenance of all common property including signage. These documents shall be recorded against the property and proof of recording shall be submitted to the city prior to issuance of any building permits. b. Revise the plat to dedicate a 10-foot drainage and utility easement along the south (front) property line of both lots and a six-foot drainage and utility easements along both sides of the new property line separating Lot 1 from Lot 2. c. Revise the plat to include the detention ponds, any infiltration basins and wetlands in drainage and utility easements. th 3. The sidewalk requirement for Kilmer Lane and 6 Avenue is waived at this time. 4. This approval shall expire one year after the date of approval, unless the applicant has filed a complete application for the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
