HomeMy WebLinkAboutCity Council Resolution 2018-104 C ITY OF P LYMOUTH R ESOLUTION N O. 2018-104 R ESOLUTION A PPROVING F INAL P LAT AND D EVELOPMENT C ONTRACT FOR “G REENWAY W EST” FOR P ROPERTY LOCATED W EST OF T ROY L ANE TH AT 58 A VENUE (2017 083-F) WHEREAS, Pulte Homes of Minnesota LLC has requested approval of a final plat for the first phase of development for Greenway West to include 56 single-family lots for property located west of th Troy Lane at 58 Avenue; and WHEREAS, the property is presently legally described as follows: The North 368.5 feet of the South 635.8 feet of the East One-Half of the Northwest Quarter of Section 6, Township 118, Range 22, Hennepin County, Minnesota. AND The South 270 feet of the Southeast Quarter of the Northwest Quarter of Section 6, Township 118, Range 22, Hennepin County, Minnesota. AND The North 283.0 feet of the South 921.5 feet of the East Half of the Northwest Quarter of Section 6, Township 118, Range 22, Hennepin County, Minnesota, except the North 250 feet of the East 435.6 feet thereof. AND That part of the West 895 feet of the North 922 feet of the Northeast Quarter of the Southwest Quarter of Section 6, Township 118, Range 22, Hennepin County, Minnesota, lying northeasterly of a line drawn southeasterly from a point on north line thereof distant 303.08 feet east from the northwest corner thereof at an angle of 54 degrees from the north line thereof and lying northwesterly of a line drawn from a point on the south line thereof distant 631.56 feet east from the southwest corner thereof to a point on the east line thereof distant 587 feet south from the northeast corner thereof. AND That part of the West 895 feet of the North 922 feet of the Northeast Quarter of the Southwest Quarter of Section 6, Township 118, Range 22, Hennepin County, Minnesota, lying northerly of a line drawn northwesterly from the southeast corner thereof at an angle of 32 degrees 22 minutes 29 seconds from the south line thereof and lying southwesterly Resolution 2018-104 File 2017083-F Page 2 of a line drawn southeasterly from a point on the north line thereof distant 303.08 feet east from the northwest corner thereof at an angle of 54 degrees from the north line thereof and lying northwesterly of a line drawn from a point on the south line thereof distant 631.56 feet east from the southwest corner thereof to a point on the east line thereof distant 587 feet south from the northeast corner thereof. WHEREAS, City staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Pulte Homes of Minnesota LLC for a final plat for Greenway West; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the Mayor and City Manager are authorized to execute the development contract on behalf of the City; and FURTHER, that the following conditions apply to said plat: 1. The final plat for Greenway West is approved in accordance with the plans received by the City on January 18, 2018, except as may be amended by this resolution. 2. Prior to commencement of tree removal or grading operations, the Developer shall install and request inspection of tree preservation fencing and silt/erosion control fencing. 3. Prior to recording the final plat, the Developer shall: a) Execute the development contract and provide the related financial guarantees and fees. b) Receive City approval of final construction plans. c) Remove existing structures from the site. Demolition permits are required for removal of existing structures that contain over 120 square feet. d) Provide a separate ten-foot wide trail easement along the east side of those properties that abut Troy Lane. e) Pay the required park dedication cash fee. f) Pay the required tree restitution amount. g) Provide all required agreements and easements. 4. Prior to issuance of building permits for lots abutting wetlands, permanent wetland buffer monument signs shall be installed pursuant to ordinance requirements. 5. The homeowner’s association documents shall address: a) responsibilities for maintenance and repair of wetland buffers, buffer monuments, developer- installed retaining walls, sidewalks, trails, and any other similar or common features; and b) prohibition of structures and the clearing of native vegetation within wetland buffers. The Developer shall notify potential buyers and buyers at closing about the future northerly roadway extension of Walnut Grove Lane, and about the future street improvement project for Troy Lane. 7. The Developer shall post a sign near the north terminus of Walnut Grove Lane to notify passersby that the street will be extended in the future. 8. The Developer shall provide a temporary turn-around at the north terminus of Walnut Grove Lane, either on or off the site, that is large enough to allow a 40-foot long school bus to turn around without backing up. 9. The temporary cul-de-sac at the northerly terminus of Walnut Grove Lane cannot encroach on the property of any developed lots. 10. A variance was approved to allow the two existing homes addressed as 5705 and 5755 Vagabond Lane (Lots 36 and 35 of Block 2, respectively) to remain on private well and septic until such time as the properties to the south may develop. 11. Direct vehicular private driveway access is denied from Troy Lane to the lots abutting Troy Lane, making the yard areas between the homes on those lots and Troy Lane “equivalent” yards. 12. The property at 6000 County Road 101 (PIN 06-118-22-23-0004) must be included with the final plat for phase 2 development of Greenway West, in order to acquire and create the homeowner’s association open space outlot (shown as Outlot B on the preliminary plat plans). 13. Standard Conditions: a. No building permits shall be issued until the final plat and development contract are recorded with Hennepin County, all streets and utilities are installed, and all required easements and agreements are filed and recorded with Hennepin County and proof of recording is submitted to the City. b. Development standards and setbacks for this plat shall comply with the RSF-3 zoning standards. No variances are granted or implied. c. If the required sidewalks are not installed when the streets are installed, no building permits shall be issued for lots abutting the future sidewalk unless a separate sidewalk agreement is provided for each affected lot. d. Any signage shall require separate permits and shall comply with the City’s sign regulations. e. Separate building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence measuring not less than three feet in height shall be installed at the top of retaining walls that exceed four feet in height. f. No trees shall be planted in the boulevard. g. Compliance with the City’s tree preservation/reforestation/restitution regulations. h. Removal of all hazardous trees at the owner's expense. i. No trees shall be planted in drainage and utility easements containing storm sewer or sanitary sewer pipes. Resolution 2018-104 File 2017083-F Page 4 j. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under section 512 of City Code.
