R ESOLUTION N O. 2018-102
R ESOLUTION A PPROVING R EQUEST FOR P AYMENT N O. 4 AND F INAL
E LM C REEK S TREAM R ESTORATION (14006)
WHEREAS, the City of Plymouth as the owner and Minnesota Native Landscapes as the
contractor, have entered into an agreement for the Elm Creek Stream Restoration, said
agreement was approved by the City Council on June 23, 2015; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $588,720.00 and that the value of the work
to date is $655,458.35 and is approved. The final contract amount is $66,738.35
(or 11.3%) above the original contract amount.
2. That the work performed by the contractor for the Elm Creek Stream Restoration
and certified to the Council by the engineer as acceptable, being the same, is
released from the contract except as to the conditions of the performance bond,
any and all legal rights of the owner, required guarantees and correction of faulty
work after final payment.
3. Request for Payment No. 4 and Final in the amount of $51,772.92 to Minnesota
Native Landscapes for the Elm Creek Stream Restoration is approved and the
Administrative Services Director is authorized and directed to pay the same
forthwith.
4. Funding for this project will be from the following sources: the Elm Creek
Watershed Management Commission in the amount of $247,112.84, Hennepin
County in the amount of $10,000.00, and the Water Resources Fund in the
amount of $431,118.43.
