HomeMy WebLinkAboutCity Council Resolution 2018-090 C ITY OF P LYMOUTH R ESOLUTION N O. 2018-090 R ESOLUTION A PPROVING A P RELIMINARY P LAT FOR “S UMMERS E DGE P HASE III” FOR P ROPERTY LOCATED AT O UTLOT A, S UMMERS E DGE S OUTH & 18740 M EDINA R OAD (2017107) WHEREAS, Summergate Companies has requested approval of a preliminary plat for the roughly 15-acre parcel presently legally described as: Outlot A, Summers Edge South, Hennepin County, Minnesota And That part of Lot 1, Block 1, Busch Properties South lying West of the Southerly extension of the East line of Lot 1, Block 1, Busch Properties North, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request for a preliminary plat at a duly called public hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Summergate Companies for a preliminary plat for “Summers Edge Phase III”, subject to the following conditions: 1. A preliminary plat is approved to allow the property to be subdivided into 45 lots for single- family homes, in accordance with the application and plans received by the city on November 17, 2017, and January 10, 2018, except as may be amended by this resolution. 2. Approval of the preliminary plat is contingent upon City Council approval of the rezoning of the site to RSF-3. 3. Prior to recording the final plat, the applicant shall; 1) receive city approval of final construction plans; 2) execute a development contract and submit related fees and financial guarantees; 3) receive a lot line adjustment approval by Hennepin County; and 4) receive city approval of street easement vacations. 4. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Submit HOA documents or covenants that include the following: 1) Assigning maintenance of common improvements including the wetland buffer, wetland buffer monuments, retaining walls, subdivision signs, easement landscaping areas, etc. Resolution No. 2018-090 File 2017107 Page 2 2) Disclosure indicating that the nearby greenhouses are used year-round and the agricultural use may produce noise, odor or lights related to the growing operation and that the heating method requires the grinding of trees into wood chips. 3) Disclosure that roads stubbed to the east will eventually get extended when subdivision is proposed. b. Submit separate disclosures for the first purchasers indicating that the greenhouses are used year-round and the agricultural use may produce noise, odor or lights related to the growing operation and that the heating method requires the grinding of trees into wood chips. c. Submit fire flow calculations with each phase of the development and provide the total square footage of the largest proposed structure. d. Submit an executed, 10-foot trail easement adjacent to the right-of-way for Brockton Lane. e. Submit an executed, 10-foot trail easement adjacent to the right-of-way for Medina Road. f. Submit an executed, temporary construction easement for the off-site improvements and a permanent drainage and utility easement for the pond. g. Submit a revised plan showing a street connection to Medina Road either on the property or on the property to the east. If and when the property to the east develops, the street shall be rerouted to align with Yellowstone Lane. h. Payment of park dedication cash fee in lieu of land dedication for 45 new dwelling units, in accordance with the dedication ordinance in effect at the time of filing for the final plat. i. A development contract and financial guarantees are required for this project and would be drafted as part of a final plat application. j. Revise the plans as follows: th 1) Add a 10-foot trail easement with an 8-foot trail along Brockton Lane from 40 Avenue south to the Medina Road intersection (including a pedestrian entrance). The trail will be constructed by the developer at the time the streets go in. 2) Revise the plans for the street connecting to Medina Road comprising of a 24-foot wide street with bituminous curb with a typical street as approved by the City Engineer. 3) Add wetland buffer monuments along the edge of the wetland buffers consistent with section 21670.07 of the zoning ordinance. 4) Add the high water elevation, emergency overflow and normal water level for all ponds and wetlands. 5) Revise the lowest floor elevation of all homes abutting ponds and wetland to be two feet above the high water elevation. 6) Provide road profiles. 7) Add sewer service inverts to all lots. 8) Revise the storm sewer plans; any reinforced concrete pipe will be public pipe and must have a 20-foot drainage and utility easement over it, and nothing will be allowed in the easement (no sheds, no fences, no trees etc.). 9) Revise the drainage plans to eliminate most or all back yard reinforced concrete pipe. 10) Revise the plans so garage floors are at least one foot higher than the lot property corner. Resolution No. 2018-090 File 2017107 Page 3 thth 11) Revise the street names to be 40 Avenue, Alvarado Lane, 39 Avenue and Zircon Lane. 12) Add project number 2017107 to all sheets. 13) Lot 6, Block 3 shall include an easement in the favor of the HOA along Medina Road addressing the HOA’s responsibility for the maintenance and replacement of landscaping on the berm. 5. No retaining walls are permitted in the trail easement. 6. No driveway access to Brockton Lane shall be permitted. 7. Prior to the issuance of a building permit, the applicant shall submit a survey indicating: a. A minimum of two front yard trees to be preserved or planted. b. Silt fence and tree preservation fencing installed consistent with city code. 8. Standard Conditions: a. No building permits shall be issued until the final plat, easements, and other recordable documents are filed and recorded with Hennepin County. b. Development standards and setbacks for this plat shall comply with the RSF-3 zoning standards. No variances are granted or implied. c. All retaining walls over four feet shall require issuance of a building permit and a three- foot fence installed on top of the wall. d. Compliance with the city’s tree preservation regulations. e. No trees shall be planted in the public right-of-way. f. Signs shall require a separate permit and comply with section 21155 of the zoning ordinance. g. This approval shall expire one year after the date of approval, unless the applicant has submitted a complete final plat application, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
