HomeMy WebLinkAboutCity Council Resolution 2018-023CITY OF PLYMOUTH RESOLUTION No. 2018-023 RESOLUTION APPROVING A SITE PLAN, CONDITIONAL USE PERMIT AND VARIANCE FOR A CVS PHARMACY FOR PROPERTY LOCATED AT 17405 AND 17435 COUNTY ROAD 6 (2017087) WHEREAS, Five Star Development of Alabama, Inc. has requested approval of a site plan, conditional use permit and variance to allow redevelopment for a new CVS Pharmacy on 1.5 acres of land presently legally described as follows: Lot 1 and Lot 2, Block 1, OAKWOOD SQUARE, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Five Star Development of Alabama, Inc. for a site plan, conditional use permit and variance to allow redevelopment for a new CVS Pharmacy on the subject 1.5 acres of land, subject to the following conditions: 1. A site plan is approved to allow construction of a 9,600 square foot pharmacy/store and related site improvements, in accordance with the civil plans received by the City on November 17, 2017, and elevation drawings received by the City on November 14, 2017, except as may be amended by this resolution. A conditional use permit and variance is approved to allow an accessory pick-up window and related stacking lane on the east side of the building (which would be set back less than 300 feet from the residential lot line to the east), based upon the finding that all applicable conditional use permit and variance standards are met. 3. Approval of the site plan, conditional use permit and variance is contingent upon approval of the rezoning of the site. 4. Prior to commencement of the project, the developer shall obtain the required demolition permits, tank removal permits, and building permits. In addition, the developer shall install and request inspection of silt/erosion control fencing prior to commencement of the project. Resolution 2018-023 File 2017087 Page 2 5. Prior to issuance of the building permit, the developer shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a) Provide evidence from Hennepin County that the two parcels have been combined into one legal lot of record. b) Provide additional information on the lighting plan relating to house -side shielding of lighting fixtures and compliance with curfew regulations. c) Either receive separate City approval to vacate, or obtain an encroachment agreement for, the existing drainage and utility easement that lies between the two parcels. d) Execute the required Site Improvement Performance Agreement and provide the related financial guarantees and fees. e) Obtain City approval of final construction plans. f) Demonstrate compliance with City and watershed requirements pertaining to drainage and treatment of runoff. g) Obtain any required permits from Hennepin County and the watershed district. h) Provide proof -of -recording of a maintenance agreement for the infiltration basins. i) Submit fire flow calculations. j) Revise the building elevations to create a focal point (architectural design feature) at the northwest corner of the building, as approved by staff. k) Revise the building elevations to enlarge the windows to have a minimum vertical measurement of four feet on the north and south facades by extending the windows downward, as approved by staff. 1) Revise the building elevations to add windows (either vision glass, spandrel glass, or display case glass) and related awnings in the east portion of the north fagade facing County Road 6, as approved by staff. m) Revise the plans to include a 2- to 3 -foot high berm in the 20 -foot wide greenspace / landscape strip along the east lot line. 6. Construction parking for this development shall not occur in the residential neighborhoods to the east or south. 7. This resolution authorizes the mayor and manager to sign a consent to terminate the existing private parking easement agreement between current gas station site (which is a portion of the future CVS site) and the existing shopping center site to the south, because both the CVS site and the shopping center site would provide parking ratios that comply with City regulations. 8. Hours of operation for the pick-up window shall be limited to between 7 AM and 10 PM. 9. Standard Conditions: a) Any rooftop or ground -mounted mechanical equipment shall be screened consistent with the requirements of the zoning ordinance to match the building. b) Any signage shall require separate permits and shall comply with the City's sign regulations. Resolution 2018-023 File 2017087 Page 3 c) The intercom related to the pick-up window shall comply with the City's noise standards. d) The developer shall not use the abutting County Road 6 or 101 trails for storage or access to the site. The developer shall be responsible for any damage done to the trails during construction. e) Compliance with all fire codes, including those for hydrant location. Hydrants are required in approved locations, including within 50 feet of the fire department connection. f) Identify the fire department connection and post -indicator valve locations. The fire department connection is required in an approved location at the building's main entrance. g) Fire lane signage shall be provided in locations to be field identified by the Fire Inspector. h) Compliance with turning radius requirements throughout the site. i) An approved solenoid valve is required on the combination fire/domestic water supply line to the building. j) A cross -easement agreement for unobstructed fire access and water supply is required in perpetuity between the subject site and the property immediately to the south. k) The site plan, conditional use permit and variance shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the landowner, has received prior approval from the City to extend the expiration date, as regulated under Sections 21045.09, 21015.07, and 21030.06, respectively, of the zoning ordinance.
