FOR PROPERTY LOCATED AT 13105 12TH AVENUE (2017098) WHEREAS, Buhler Inc., has requested approval of a site plan amendment to allow construction of a building addition and parking lot changes for the property presently legally described as follows: Lot 1, Block 1, Reinhard Industrial Park, the South Boundary line of which has been judicially determined by placing Judicial Landmarks pursuant to the Order in Torrens Case No. 5136, at the Northwest and Northeast corners of the South Half of the Northeast Quart of Section 34, Township 118, Range 22. Together with a switch tract spur tract and drainage easement over a part of Lot 2, Block 1, Reinhard Industrial Park as contained in Book 76, Page 419512. Hennepin County Minnesota. Torrens Property. Torrens Certificate No. 531305. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Buhler Inc., for a site plan amendment for the construction of an 8,500 square foot addition and parking lot changes, subject to the following conditions: 1. A site plan is approved to allow construction of two-story addition and parking lot changes and related site improvements, in accordance with the plans received by the city on October 19, November 17, November 22, and December 14, 2017, except as amended by this resolution. 2. All signage shall require separate permits. All signs shall be in conformance with the sign regulations in section 21155 of zoning ordinance. 3. A separate building permit is required prior to construction of the project. 4. Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Execute a site improvement performance agreement and submit a financial guarantee pursuant to section 21045.10 of the zoning ordinance. b. Obtain any required permits from other agencies including, but not limited to the watershed district. c. Obtain city approval of final construction plans. Resolution 2018-017 File 2017098 Page 2 Revise the plans to meet fire code requirements as follows: 1) Submit updated fire flow calculations for the project based on the new hydrant locations. Revise the plans to meet engineering requirements as follows: 1) No landscaping is allowed in any of the easements or by any utilities. 2) Add perimeter control where the exposed soils drain onto paved surfaces on the erosion control plan. 3) Add casting number to utility plan. 4) Add city project number 2017098 to landscape plan. 5. Review and approval of the stormwater and watershed plans. 6. All construction parking shall be located on-site. 7. All rooftop and mechanical equipment shall be screened as required by section 21130.05 of the zoning ordinance. 8. Silt fence shall be installed and inspected prior to any grading or construction on the site. 9. Standard Conditions: a. The applicant shall remove any diseased or hazardous trees. b. The site shall remain in conformance with section 2025 of the city code regarding noise regulations. c. No trees may be planted in the public right-of-way. d. Compliance with the city's lighting regulations. e. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. 10. The site plan shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21045.09 of the zoning ordinance.
