HomeMy WebLinkAboutCity Council Resolution 2018-013CITY OF PLYMOUTH RESOLUTION No. 2018-013 RESOLUTION APPROVING PURCHASE AGREEMENT WITH DEAN AND KRISTIN SCHWAPPACH FOR PROPERTY LOCATED AT 5725 JUNEAU LANE NORTH WHEREAS, the City is proposing to acquire property legally described in the attached Exhibit "A" ("Property') under the terms of the proposed purchase agreement between Dean and Kristin Schwappach ("Sellers") and the City ("Purchase Agreement"), attached hereto and incorporated herein as Exhibit "B"; and WHEREAS, Minn. Stat. § 462.356, Subd. 2 requires that the Planning Commission review the City's proposed acquisitions and dispositions of property; and WHEREAS, Minn. Stat. § 462.356, Subd. 2 provides for an exception from the Planning Commission review requirement upon 2/3 vote of the City Council dispensing with the requirement and finding that the acquisition or disposal of the property has no relationship to the comprehensive municipal plan; and WHEREAS, the City has negotiated a purchase price of $410,000 for said 5.01 acre property; and WHEREA, the purchase agreement is contingent on the City's satisfaction with the results of a Phase I Environmental Audit; and WHEREAS, the City Council has reviewed said purchase agreement. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the purchase agreement between the City of Plymouth and Dean and Kristin Schwappach is approved and the Mayor and City Manager are authorized to sign said purchase agreement, and further, that funding will be from the Park Dedication Fund. APPROVED by the City Council on this 9th day of January, 2018.
