HomeMy WebLinkAboutCity Council Resolution 2017-388 CITY OF PLYMOUTH RESOLUTION NO. 2017-388 R ESOLUTION A PPROVING F INDINGS OF F ACT FOR THE R EZONING OF L AND LOCATED AT 5815, 5845, AND 5905 T ROY LANE, 5705 AND 5755 V AGABOND L ANE, AND 6000 C OUNTY R OAD 101 (2017 083) WHEREAS, Pulte Homes of Minnesota, LLC has requested reclassification of the zoning from FRD (future restricted development) to RSF-3 (single family detached 3) for roughly 32.3 acres presently legally described as follows: The North 283 feet of the South 921.5 feet of the East Half of the Northwest Quarter of Section 6, Township 118, Range 22, Hennepin County, Minnesota, except the North 250 feet of the East 435.6 feet thereof. AND The North 368.5 feet of the South 638.5 feet of the East Half of the Northwest Quarter of Section 6, Township 118, Range 22, Hennepin County, Minnesota. AND The South 270 feet of the Southeast Quarter of the Northwest Quarter of Section 6, Township 118, Range 22, Hennepin County, Minnesota. AND All that part of PID No. 06-118-22-31-0006, Hennepin County, Minnesota, described as follows: Beginning at a point on the north line of the Northeast Quarter of the Southwest Quarter of Section 6, Township 118, Range 22, distant 303.08 feet East from the Northwest corner thereof; thence South 35 degrees 19 minutes 02 seconds East (assuming said north line has a bearing of South 89 degrees 19 minutes 02 seconds East) a distance of 361.67 feet; thence South 12 degrees 08 minutes 59 seconds West 129.76 feet; thence South 88 degrees 18 minutes 40 seconds West 124.01 feet; thence North 50 degrees 03 minutes 23 seconds West 109.81 feet; thence North 13 degrees 37 minutes 47 seconds West 127.18 feet; thence North 22 degrees 38 minutes 39 seconds West 155.63 feet; thence North 03 degrees 46 minutes 52 seconds West 61.65 feet; thence North 40 degrees 07 minutes 11 seconds West 36.72 feet to said north line; thence South 89 degrees 19 minutes 02 seconds East, along said north line, a distance of 144.00 feet to the point of beginning. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected land from FRD to RSF-3. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request for reclassification of the zoning from FRD to RSF-3 for roughly 32.3 acres (as legally described above), based on the following findings: 1. The requested RSF-3 zoning is consistent with LA-1 guiding. 2. The proposed density is consistent with LA-1 guiding. 3. The proposed single-family development and lot arrangement would comply with the RSF-3 zoning standards. 4. The adjacent properties to the east have been rezoned to RSF-3, therefore, rezoning this site to RSF-3 would be compatible with the existing zoning in the area. 5. Adequate infrastructure would be available to support the proposed development. APPROVED by the City Council on this 12th day of December, 2017.
