HomeMy WebLinkAboutCity Council Resolution 2017-386 C ITY OF P LYMOUTH R ESOLUTION N O. 2017-386 R ESOLUTION A PPROVING THE V ACATION OF W ALKWAY E ASEMENTS WITHIN P LYMOUTH B USINESS C ENTER 4 TH A DDITION WHEREAS, a public hearing with respect to said vacation was scheduled for December 12, 2017, in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of December 12, 2017; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council held a public hearing on December 12, 2017 to inform any and all interested parties relevant to the vacation of the Walkway Easements within Plymouth Business Center th 4 Addition; and WHEREAS, it was determined by the City Council that said Walkway Easements were not needed for Public purposes. NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the following Walkway Easements be vacated: PARCEL DESCRIPTION: th Lot 2, Block 1, Plymouth Business Center 4 Addition, Hennepin County, Minnesota. WALKWAY EASEMENTS: The north 20 feet of Outlot A, Criterion M.P.U.D., Plymouth, Minnesota, according to the plat thereof found on file and of record in the office of the Register of Deeds in and for said county. and, The south 10 feet of the north 30 feet of said Outlot A, Criterion M.P.U.D., Plymouth, Minnesota. FURTHER, it is not in the public’s interest to vacate the north 10 feet of the north 20 feet and it shall be retained by the City. FURTHER, it is not in the public’s interest to vacate the 10 foot walkway easement lying southeasterly of, parallel to and adjacent to the southeasterly line of the Permanent Easement for Highway Purposes per Doc. No. 7408460 and 6506892 and it shall be retained by the City. Resolution No. 2017-386 Page 2 of 2 FURTHER, it is not in the public’s interest to vacate the walkway easements within the Permanent Easement for Highway Purposes per Doc. No. 7408460 and 6506892 and they shall be retain by the City. BE IT FURTHER RESOLVED that said vacation shall not affect the authority of any person corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
