HomeMy WebLinkAboutCity Council Resolution 2017-373 C ITY OF P LYMOUTH R ESOLUTION N O. 2017-373 TH R ESOLUTION A PPROVING F INAL P LAT FOR “F RETHAM 26 A DDITION” FOR P ROPERTY LOCATED AT 3835 D ALLAS L ANE (2017 072-F) WHEREAS, Lake West Development, LLC has requested approval of a final plat for five single- family lots for property located at 3835 Dallas Lane; and WHEREAS, the property is presently legally described as Outlot E, Criterion M.P.U.D., Hennepin County, Minnesota. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Lake West Development, LLC for a final plat th for Fretham 26 Addition, subject to the following conditions: th 1. The final plat for Fretham 26 Addition is approved in accordance with the plans received by the City on October 27, 2017, except as may be amended by this resolution. 2. Prior to recording the final plat, the developer shall: a) Execute the required site improvement performance agreement and provide the related financial guarantees and fees. The agreement shall cover, but is not limited to, requirements for grading, drainage, storm water management, and erosion control improvements, as well as for setting of iron monuments. b) Receive City approval of final construction plans. c) Pay the required park dedication fee for four new residential lots. d) Provide all required easements and agreements. e) Address the neighbor’s shed encroachment in the southwest corner of the site. f) Correct the proposed drainage and utility easements and building setbacks on the plans. g) Relocate the detached structures and existing driveway and in compliance with setback regulations for proposed Lot 2, as shown on the preliminary plat. thth h) Revise the plans to identify existing hydrant locations north of 38 Place and south of 38 Avenue. 3. Prior to commencement of site development including grading operations, the developer shall install and request inspection of tree protection fencing and silt fencing, and shall obtain the required NPDES permit. 4. Prior to issuance of building permits, the developer shall complete grading and installation of any and all required Best Management Practices (BMP’s) for management of drainage and storm water runoff. Resolution 2017-373 File 2017072-F Page 2 5. The sidewalk requirement was waived because there are no sidewalks in the area. 6. Standard Conditions: a. No building permits, including those for a model home, shall be issued until the final plat is recorded with Hennepin County. b. Development standards and setbacks for this plat shall comply with the RSF-2 zoning standards. No variances are granted or implied. c. Compliance with the City’s tree preservation and landscaping regulations. d. Removal of all hazardous trees at the owner's expense. e. No trees shall be planted in the boulevard. f. No trees shall be planted in drainage and utility easements containing storm sewer or sanitary sewer pipes. g. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 512 of City Code.
