R ESOLUTION A PPROVING A P RELIMINARY P LAT AND S ITE P LAN FOR AN
A PARTMENT B UILDING ON P ROPERTY L OCATED AT 18140, 18220,
AND 18240 S TATE HIGHWAY 55 (2017 075)
WHEREAS, Beacon Interfaith Housing Collaborative has requested approval of a preliminary plat
and site plan to allow a 47-unit apartment building to be called Cranberry Ridge on 2.4 acres of land
presently legally described as follows:
Lot 1 and the Northwesterly one-half of Lot 2, Block 1, Osier Addition, and all that part of the
Northwest Quarter of the Northeast Quarter of Section 18, Township 118, Range 22, lying
Northeasterly of State Highway No. 55 as now traveled and used and Northwesterly of Osier
Addition, Hennepin County, Minnesota.
AND
Lot 3 and the Southeasterly one-half of Lot 2, Block 1, Osier Addition, Hennepin County,
Minnesota.
AND
Lots 4 and 5, Block 1, Osier Addition, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the request by Beacon Interfaith Housing
Collaborative for a preliminary plat and site plan for a 47-unit apartment building, subject to the following
conditions:
1. A preliminary plat is approved to replat three parcels into one lot, in accordance with the
plans received by the City on September 11, 2017, except as may be amended by this
resolution.
2. A site plan is approved to allow construction of a 47-unit apartment building and related site
improvements, in accordance with the plans received by the City on September 11, 2017, and
the revised plan received by the City on November 22, 2017, except as may be amended by
this resolution.
3. Approval of the preliminary plat and site plan is contingent upon approval of the reguiding
and rezoning of the site, as well as vacation of existing street right-of-way along Highway 55.

4. Prior to commencement of grading operations, the developer shall install and request
inspection of silt/erosion control fencing.
5. Prior to recording the of final plat, the developer shall:
a) Remove the existing structures from the site. Demolition permits are required for
removal of existing structures that contain over 120 square feet in building size.
b) Pay the required park dedication fee.
6. A separate building permit is required prior to commencement of the project.
7. Prior to issuance of the building permit, the developer shall:
a) Record the final plat with Hennepin County.
b) Execute the required Site Improvement Performance Agreement and provide the related
financial guarantees and fees.
c) Obtain City approval of final construction plans.
d) Demonstrate compliance with City and watershed requirements pertaining to drainage
and treatment of runoff.
e) Assess Highway 55 noise impacts and incorporate whatever noise mitigation measures
are necessary (e.g., extra wall insulation, ridge vents, triple-pane windows, etc.) to ensure
compliance with state noise standards.
f) Pay into the Community Planting Fund for the planting shortfall in trees on the site.
g) Obtain any required permits from MnDOT and the watershed district.
h) Provide proof of recording of a maintenance agreement for the storm water vault and
filtration basins.
i) Revise the plans to eliminate the retaining wall from the required drainage and utility
easements, or if the retaining wall is allowed by the City to remain in the drainage and
utility easement, execute and record an encroachment agreement for the retaining wall.
j) Submit fire flow calculations.
k) Submit a separate building permit for any retaining walls that would be four feet in height
or higher, and provide the required safety fence at the top of the retaining wall.
l) Provide the cut sheets for lighting fixtures indicating compliance with the lighting
regulations.
m) Remove landscaping and improvements (including trash pad) from the street right-of-way
and from the ten-foot wide drainage and utility easement abutting the street right-of-
way.
n) Provide plans showing that heating/cooling/ventilation units and equipment for the
building shall be painted or colorized to match the building.
o) Revise the plans to keep private watermain out of the public street.
p) Revise the plans to indicate adequate screening along the east lot line, as approved by
City staff.

8. Prior to issuance of a certificate of occupancy, the developer shall:

a) Install a five-foot wide concrete sidewalk on the west side of 45 Avenue between the
site and Old Rockford Road.
b) Install a protective guard rail/bollard system, as approved by the City, around the outside
of the fenced outdoor play area.
9. Any emergency generator shall require separate review and approval via an administrative
permit prior to its installation.
10. Lease documents shall prohibit on-site storage of recreational vehicles.
11. Parking would be allowed on one side of the 28-foot wide public street within the
development. One side of the street shall be signed for “No Parking”.
12. The Plans shall be revised to delineate the public street from the private driveways with
driveway aprons and curb with gutter.
13. Final design and approval of the storm water system must be in place prior to approval of the
final plat. A public/private agreement is required for the storm water system, and such
agreement must be reviewed by the City Council in conjunction with the final plat. The
agreement shall specify that the applicant/property owner shall be 100 percent responsible
for the drainage system, including for the drainage from the public street. The agreement
shall also indemnify the City of any and all liability related to public storm water entering the
on-site private drainage system.
14. Construction parking for the development shall be either on the site or at a location approved
by the City. In no case shall parking be allowed in the residential neighborhoods to the north
of Old Rockford Road.
15. Standard Conditions:
a) Development standards and setbacks for this plat shall comply with the RMF-4 zoning
regulations. No variances are granted or implied.
b) Any rooftop or ground-mounted mechanical equipment shall be screened consistent with
the requirements of the zoning ordinance to match the building.
c) Any signage shall require separate permits and shall comply with the City’s sign regulations.
d) Compliance with all fire codes, including those for hydrant location. Hydrants are required
in approved locations, including within 50 feet of the fire department connection.
e) Identify the fire department connection and post-indicator valve locations. The fire
department connection is required in an approved location at the building’s main entrance.
f) Secondary access is waived, provided the watermain shall be looped.
g) Fire lane signage shall be provided in locations to be field identified by the Fire Inspector.
h) Compliance with turning radius requirements throughout the site, including the turn from

45 Avenue into the cul-de-sac turn-around.

i) An approved solenoid valve is required on the combination fire/domestic water supply line
to the building.
j) In lieu of providing a fire lane within 50 feet of all sides of the building, the applicant shall
provide an approved NFPA 13 fire sprinkler system, and may be required to design
additional fire safety features into the construction of the building.
k) Removal of all hazardous trees at the owner's expense.
l) No trees shall be planted in the boulevard.
m) The preliminary plat and site plan shall expire one year after the date of approval, unless the
property owner or applicant has started the project, or unless the applicant, with the
consent of the landowner, has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Section 510 of city code
and Section 21045.09 of the zoning ordinance.
