HomeMy WebLinkAboutCity Council Resolution 2017-338 C ITY OF P LYMOUTH R ESOLUTION N O. 2017-338 R ESOLUTION A PPROVING V ARIANCES FOR D AVID AND A NNE C RAIG FOR P ROPERTY LOCATED AT 2515 M AGNOLIA L ANE N ORTH (2017 090) WHEREAS, David and Anne Craig have requested approval of variances to lot area, lot width, and building setback to allow construction of a new home on a vacant lot; and WHEREAS, the variance would allow construction of a new home and related site improvements on a non-conforming lot that contains 10,385 square feet where 18,500 square feet is the minimum area required and contains 66 feet in width where 110 feet is the minimum lot width required in the RSF-1 zoning district; and WHEREAS, the variance would allow a side yard (north) setback of 12 feet, 4 inches, where 15 feet is the minimum required in the RSF-1 zoning district; and WHEREAS, the subject property is legally described as That Part of Lot 3, Block 3, Elmhurst Gardens, Lying South of the North 1 Foot, Front and Rear, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by David and Anne Craig for lot area, lot width, and side yard setback variances to allow a 12-foot, 4-inch side yard setback where 15 feet minimum is specified, for 2515 Magnolia Lane North, subject to the following findings and conditions: 1. The requested variance is hereby approved, in accordance with the application and plans received by the City on October 2, 2017, except as may be amended by this resolution. 2. The requested variance is approved, based on the finding that all applicable variance standards have been met. Specifically, a. The requested variance for a new single-family home is consistent with the residential uses listed for this land use classification in the comprehensive plan. b. The applicant has demonstrated that there are practical difficulties in complying with the ordinance regulations, because: 1. the request is reasonable and the property would be used in a reasonable manner; 2. the request is due to circumstances not created by the landowners as the lot created in 1914 does not meet the minimum area and width requirements for the RSF-1 zoning district; and 3. the variance would not alter the essential character of the lot or neighborhood as the lot is in character with the surrounding lots within the subdivision and contained a single- family home from the years 1948 to 2015. The requested variance is not based upon economic considerations, but rather, is based upon a desire to add a more livable home that is in character with the neighborhood than the previous cabin-style home that was located on the lot. d. The requested variance and resulting construction would not be detrimental to the public welfare, nor would it be injurious to other land or improvements in the neighborhood. The proposed home would be located further from the side lot lines than the neighboring homes to the north and south. e. The requested variance and resulting construction would not impair an adequate supply of light and air to adjacent properties, nor would it increase traffic congestion or the danger of fire, endanger the public safety, or substantially diminish property values within the neighborhood. The proposed home would increase the value of this lot. f. The variance requested is the minimum action required to address the practical difficulties. The proposed home would meet or exceed all other zoning regulations. 3. A building permit is required prior to commencement of the project. 4. Prior to issuance of the building permit, the applicant shall submit a revised certified survey that identifies the: 1) proposed home and attached garage location as shown on the site plan; 2) existing and proposed elevation contours; 3) garage and lowest floor elevations; 5) location of either at least two existing preserved and protected trees or two new, to be planted, front yard trees, or a combination thereof, pursuant to zoning ordinance requirements ; and 6) drainage arrows directing stormwater toward Magnolia Lane away from the adjacent properties. 5. In conjunction with issuance of the required building permit, the applicant shall identify and mark the lot line corners. 6. The variances shall expire one year after the date of approval, unless the property owner or applicant has commenced the authorized improvement or use, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21030.06 of the Zoning Ordinance.
