P HILIP THE D EACON L UTHERAN C HURCH FOR P ROPERTY L OCATED AT 17205 C OUNTY R OAD 6 (2017009) WHEREAS, Pastor Timothy Westermeyer on behalf of St. Philip the Deacon Lutheran Church has requested approval of a conditional use permit for a columbarium on the site legally described as follows: Parcel 1: All that part of the East 600 feet of the Southwest Quarter of the Southwest Quarter of Section 29, Township 118, Range 22 lying South of the Southerly right of way line of County Road No. 6, and North of the South 577.4 feet thereof, according to the United State Government Survey thereof and situated in Hennepin County, Minnesota. Contains 214165 gross sq. ft. (7169 sq. ft. permanent hwy. easement). Parcel 2: Lots 9 and 10, Block 1, PLYMOUTH SQUARE, according to the recorded plat thereof and situated in Hennepin county, Minnesota. Lot 9 contains 21111 sq. ft. Lot 10 contains 35686 sq. ft. Parcel 3: Lot 12, Block 1, PLYMOUTH SQUARE, according to the recorded plat thereof and situated in Hennepin County, Minnesota. Contains 18529 sq. ft.; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Pastor Timothy Westermeyer on behalf of St. Philip the Deacon Lutheran Church, for a conditional use permit, subject to the following conditions: 1. A conditional use permit is approved to allow a columbarium in accordance with the application and plans received by the City on January 26, 2017, August 23, 2017, and additional information on September 21, 2017, except as may be amended by this resolution. 2. The requested conditional use permit is approved, based on the finding that all applicable standards have been met, specifically; the proposed use: a) would not endanger the public health or safety; b) would not be injurious to other properties in the vicinity or to the city as a whole; c) would not impede the orderly development of surrounding properties; d) has adequate public facilities and services available; and e) conforms to the applicable regulations of the district. 3. The permit is subject to all applicable building and fire codes, and to all city regulations and ordinances. Any violation thereof shall be grounds for revocation. 4. Prior to installation of the columbarium, the applicant shall obtain a separate approval of a building permit. Res. 2017-337 File 2017009 Page 2 5. Prior to issuance of a building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a) Show erosion and sediment controls, i.e. silt fence, bio-logs, inlet protections to downstream drains, etc. 6. Standard Conditions: a. Subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. b. The conditional use permit shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
