HomeMy WebLinkAboutCity Council Minutes 10-24-2017Adopted Minutes Regular City Council Meeting October 24, .2017 Mayor Slavik called a Regular Meeting of the Plymouth City Council to order at 7:00 p.m. in the Council Chambers of City Hall, 3400 Plymouth Boulevard, on October 24, 2017. COUNCIL PRESENT: Mayor Slavik, Councilmembers Prom, Willis, Davis, Wosje, and Carroll. Council Absent: Councilmember Johnson. Staff Present: Administrative Services Director Fischer, Community Development Director Juetten, Park and Recreation Director Evans, Public Works Director Thompson, Deputy Police Chief Plekkenpol, Fire Chief Coppa, Recreation Supervisor Koch, Communications Manager LaFave, City Attorney Knutson, and City Clerk Engdahl. Plymouth Forum There was no one present to address the Council. Presentations and Public Information Announcements (4.01) Announcement of Halloween at the Creek on October 27 Recreation Supervisor Koch announced Halloween at the Creek on October 27 at 6:00 p.m. at the Plymouth Creek Center. (4.02) Presentation of Photo Contest Winners Communications Manager LaFave and Anna Nguyen, editor of the Plymouth Magazin , announced this year's photo contest winners. Mayor Slavik announced Administrative Services Director Fischer has resigned and has accepted a position with the League of Minnesota Cities. In addition, Ice Arena Manager Abel is retiring. She thanked them for their service with the City. Approval of Agenda Mayor Slavik add a brief summary of the City Manager's evaluation as item No. 8.02 under General Business. With all members in favor, the motion carried. Consent Agenda Motion was made by Councilmember Prom and seconded by Councilmember Wosie to adopt the Consent Agenda that included the following items: (6.01) Special and Regular City Council Meeting minutes of October 10, 2017. (6.02) Resolution Approving Disbursements ending October 14, 2017 (Res2017-321). (6.03) Resolution Approving 2017-2018 Parking Lot and Trail/Sidewalk Snow Removal Routes (Res2017-322). (6.04) Resolution Approving Name for Neighborhood Park as Horseshoe Hill Park (Res2017- 323). (6.05) Resolution Approving Name for Neighborhood Park as Harvest Park (Res2017-324). (6.06) Resolution Accepting Streets for Continual Maintenance for Serenity on the Greenway (2014018 - Res2017-325). (6.07) Resolution Approving Memorandum of Understanding and Hold Harmless Agreement for Winter Farmers Market (Res2017-326). (6.08) Resolution Approving an Encroachment Agreement for Sign on Lot 1, Block 1, St. Barnabas Addition (Res2017-327). (6.09) Resolution Approving a Preliminary Plat and Conditional Use Permit for Andrey Tsapov for Property Located at 10875 South Shore Drive (2017073 - Res2017-328). With all members voting in favor, the motion carried. Recreation Supervisor Hemp briefly highlighted item No. 6.07 and stated the first Winter Farmer's Market will be held on November 4 at Bachman's, 10050 6th Avenue North. Public Hearings There were no public hearings. General Business (8.01) Report on Fencing Materials Community Development Director Juetten reported at the October 10, 2017 Council meeting, the Council requested a report regarding fencing materials. Staff recently received information from five communities regarding if they would allow a Pet Playground fence. Three cities stated they would allow it and two cities stated they wouldn't. Staff also investigated the fence permit that was issued for 14315 54th Avenue and confirmed it was issued in error. Staff recommends the following: 1) Reconfirm that the Pet Playground fencing is not allowed by city code; 2) Notify the owner of 14315 54th Avenue that the fence permit was issued in error and the fence must be removed by May 20, 2018. The City will reimburse the owner for the fence; and, 3) Require Ms. Sullivan's fence be removed at this time. Jackie Sullivan, 12415 45th Avenue North, provided addresses of residences throughout the metro area where cities have granted permits for this type of fence to be installed. She inquired why the City of Plymouth is not pursuing the addition of newer products to the ordinance. She is developing a questionnaire and petition for Plymouth residences as to whether they would potentially purchase this fence and if they find it aesthetically attractive. She agrees with the interpretation of the city code but is requesting this fencing material be considered an acceptable alternative. In response to questions from the Council, Ms. Sullivan provided the following information: • The opening of the fence is about one inch, the lower part has two layers, and it would be tricky for a dog's paw to get caught in it. However, she will inquire about this when talking to fence owners. • She installed one-third of the fence on a temporary basis in order to show pictures of how it looks on her property and to discuss with her neighbors their opinion of it. Adopted Minutes Page 3 of 4 Regular Meeting of October 24, 2017 The Council stated people have different opinions on aesthetics and that is why a large city like Plymouth needs to have standards. An error in issuing a fence permit does not provide cause to change the policy. Motion was made by Councilmember Willis and seconded by Councilmember Davis to support the recommendation of staff as follows: 1) Reconfirm that the Pet Playground fencing is not allowed by City Code; 2) Notify the owner of 14315 54th Avenue that his fence permit was issued in error and that he must remove the fence. The removal must occur prior to M!qy 30 2018. The City will reimburse the owner for the fence (amount of reimbursement will be based on documentation on the cost); and 3) Require Ms Sullivan's fence be removed at this time. With all members voting in favor, the motion carried. Mayor Slavik clarified the Council is not considering further study on this topic or amending the city code. The Council requested staff be reasonable in issuing reimbursement if the owner at 14315 54th Avenue does not have proper receipts. (8.02) City Manager's Performance Evaluation Mayor Slavik reported the. City Manager's evaluation was held on September 26, 2017. She stated City Manager Callister's overall performance rating was "exceeds requirements" and highlighted the requested goals and priorities for the City Manager for the remainder of 2017 and 2018. Reports and Staff Recommendations There were no reports and staff recommendations. Adiournment Mayor Slavik adjourned the Regular Meeting at 7:48 p.m. /Sandra R.
