R ESOLUTION N O. 2017-330
R ESOLUTION A PPROVING S ETTLEMENT A GREEMENT AND R ELEASE
WHEREAS, the City and the Cornilles entered into a Purchaser Agreement dated April 12, 2017
(“Purchase Agreement”) for the City’s conveyance to the Cornilles of real property located at 3035 Weston
Lane, Plymouth, Minnesota, 55447 (“Property”); and
WHEREAS, following the closing of the Purchase Agreement and during the site preparation and
grading phase of construction, the contractor discovered that the water connection stubs were located under
the asphalt in the cul-de-sac which would increase the cost to connect to utilities by an additional amount of
$5,587.00 in order to comply with City Code requirements; and
WHEREAS, the location of the water stub was inconsistent with the information provided by the City
to the Cornilles prior to the execution of the Purchase Agreement; and
WHEREAS, the Cornilles have requested that the City increase the payment for the extension of the
water service to the Property based on the actual location of the water stub.
WHEREAS, the City and the Cornilles desire settle any disputes related to the conveyance of the
Property under the terms of the Purchase Agreement pursuant to the terms of the Settlement Agreement
and Release attached hereto as Exhibit A (“Settlement Agreement”)
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the attached Settlement Agreement and Release is approved.
