HomeMy WebLinkAboutCity Council Resolution 2017-328 C ITY OF P LYMOUTH R ESOLUTION N O. 2017-328 R ESOLUTION A PPROVING A P RELIMINARY P LAT AND C ONDITIONAL USE PERMIT FOR A NDREY T SAPOV FOR P ROPERTY L OCATED AT 10875 S OUTH S HORE D RIVE (2017073) WHEREAS, Andrey Tsapov has requested approval of a preliminary plat and conditional use permit to create two single family homes in the RMF-2 multiple family dwelling district for roughly 0.49 acres of land presently legally described as follows: Lot 1, Block 1, KEYWAY FIRST ADDITION, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Andrey Tsapov, for a preliminary plat and conditional use permit, subject to the following conditions: 1. A preliminary plat and conditional use permit are approved to allow the property at 10875 South Shore Drive to be subdivided into two-single family lots, in accordance with the development plans received by the city on August 7, 2017, and additional information on August 24, 2017, except as amended by this resolution. 2. The requested conditional use permit is approved, based on the finding that all applicable standards have been met, specifically; the proposed use a) would not endanger the public health or safety; b) would not be injurious to other properties in the vicinity or to the city as a whole; c) would not impede the orderly development of surrounding properties; d) has adequate public facilities and services available; and e) conforms to the applicable regulations of the district. 3. Prior to release of the final plat for recording, the applicant shall: a) Pay the park dedication cash fee in lieu of land dedication for two new dwelling units, in accordance with the dedication ordinance in effect at the time of filing for the final plat. b) Revise the tree preservation plan to include the disturbance zone, the location of required tree protection fencing and the addition of two front yard trees per lot. 4. Prior to demolition of the home on Lot 1, the applicant shall obtain a demolition permit from the building division. 5. Prior to construction of both homes, the applicant shall obtain a building permit from the building division. Res. 2017-328 File 2017073 Page 2 6. Prior to issuance of a building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a) File and record the final plat with Hennepin County. b) Receive city approval of final construction plans. c) Install and request inspection of tree protection fencing and silt fencing. d) Obtain the necessary right-of-way permits from the City of Plymouth Engineering Division to th allow work in the 11 Avenue right-of-way. e) Provide a certificate of survey indicating a minimum of two front yard trees to be planted. f) Add water and sewer service connections to the plan. Add note to contact Public Works at 763- 509-5950 a minimum of 48 hours prior to making any connections. g) Show erosion and sediment controls, i.e. silt fence, inlet protections, rock entrance, etc. Extend silt fence to the rock entrance. Move silt fence to the east away from the direct root zone of the trees. th h) Add inlet protection into the catch basin at the end of the 11 Avenue cul-de-sac. i) Remove window wells from the drainage and utility easement. j) Add corner elevations to the property line. k) Add proposed lowest opening elevation for both homes. l) Direct some water from this site to adjacent roads as Engineering has raised concerns about increasing the amount of water being directed toward the existing rain garden on The Woods at Medicine Lake property. m) Submit disturbed area and new impervious surface calculations. n) Provide different line types for setback requirements versus easements. o) When using City details on plans, leave City header on. p) Provide for driveway locations on the Utility Plan and provide services out of driveways. q) Label service WYE Station on Utility Plan. r) Provide details on the existing home septic and water utilities and what is proposed. 7. Standard Conditions: a. Silt fence shall be installed prior to any construction. b. Retaining walls over four feet require issuance of a building permit and a minimum three-foot fence installed on top. c. Removal of all hazardous trees at the owner's expense. d. No trees shall be planted in the public right-of-way. e. The preliminary plat and conditional use permit shall expire one year after the date of approval, unless the property owner or applicant has applied for final plat approval, or unless the applicant, with the consent of the landowner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
