HomeMy WebLinkAboutCity Council Resolution 2017-316 C ITY OF P LYMOUTH R ESOLUTION N O. 2017-316 R ESOLUTION A PPROVING THE V ACATION OF D RAINAGE AND U TILITY E ASEMENT WITHIN B ANNER 2 ND A DDITION WHEREAS, a public hearing with respect to said vacation was scheduled for October 10, 2017, in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of October 10, 2017; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council held a public hearing on October 10, 2017 to inform any and all interested parties relevant to the vacation of Drainage and Utility Easement within Banner 2nd Addition; and WHEREAS, it was determined by the City Council that said Drainage and Utility Easement was not needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the following Drainage and Utility Easement be vacated: That part of the drainage and utility easement dedicated in Lot 1, Block 1, Banner 2nd Addition according to the recorded plat thereof, Hennepin County, Minnesota lying 10.00 feet right of the following described line: Beginning at the most southerly southwesterly corner of said Lot 1; thence on an assumed bearing of North 00 degrees 00 Minutes 00 seconds West along a westerly line of said Lot 1 a distance of 405.60 feet to a corner of said Lot 1; thence North 89 degrees 06 minutes 36 seconds West along a southerly line of said Lot 1 a distance of 177.82 feet to a corner of said Lot 1 and said line there terminating. Except: The south 10.00 feet of said Lot 1 adjacent to 10th Avenue North and except the west 10.00 feet adjacent to Nathan Lane North. BE IT FURTHER RESOLVED, that said vacation shall not affect the authority of any person corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof. APPROVED by the City Council on this 10th day of October, 2017.
