HomeMy WebLinkAboutCity Council Resolution 2017-275 C ITY OF P LYMOUTH R ESOLUTION N O. 2017-275 R ESOLUTION A PPROVING V ARIANCES TO THE S IZE AND H EIGHT TO A LLOW A D ETACHED G ARAGE FOR P ROPERTY LOCATED AT 2700 Q UAKER L ANE N ORTH (2017061) WHEREAS, Adam Nawrocki has requested approval of variances for a detached garage northeast of the home; and, WHEREAS, the subject property is legally described as follows: The north 75 feet of Lot 12, Block 6, Medicine Lake Park Third Division, Hennepin County, Minnesota; and, WHEREAS, the Planning Commission reviewed the application at a duly called public meeting. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Adam Nawrocki for variances for property located at 2700 Quaker Lane North, subject to the following findings and conditions: 1. The requested variances are approved: a) to allow an approximately 1,140 square foot detached garage, where up to 700 square feet is allowed; and b) to allow the height of the garage at 17 feet, where up to 15 feet is allowed, in accordance with the application received by the city on May 24, 2017 and June 12, 2017, except as may be amended by this resolution. a. The request for the detached garage is consistent with the residential uses listed for this land use classification in the comprehensive plan. b. Permitting the addition allows the property to be used in a reasonable manner. c. The plight of the landowner is unique and not self-created. The applicant did not build the existing detached garage that is in need of replacement. d. The variances, if granted, would not alter the essential character of the locality. e. The variance request is not based exclusively upon economic considerations; but rather the variances are requested to make improvements to the property and for additional storage space. f. The variances, and resulting construction, would not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood. It would conform to the principal structure both architecturally and aesthetically. g. The proposed addition would not impair an adequate supply of light and air to adjacent properties, nor would it substantially increase congestion of public streets, increase the danger of fire, endanger the public safety, or substantially diminish or impair property values within the neighborhood. The variances requested are the minimum action required to address or alleviate the practical difficulties and to address the storage needs of the applicant. 2. A building permit is required prior to construction of the detached garage. 3. Prior to the issuance of the building permit, the applicant shall identify, and relocate if th necessary, any private utilities located in the 30-foot vacated former 27 Avenue right-of- way. 4. Pursuant to section 21120 of the zoning ordinance, the detached garage shall be designed to be architecturally consistent with the principal building, and shall incorporate similar or complementary design elements and colors, and the same or similar roof pitch. 5. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. 6. The variances shall expire one year after the date of approval, unless the property owner or applicant has commenced the authorized improvement or use, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21030.06 of the zoning ordinance.
