HomeMy WebLinkAboutCity Council Resolution 2017-263 C ITY OF P LYMOUTH R ESOLUTION N O. 2017-263 R ESOLUTION A PPROVING F INDINGS OF F ACT FOR THE R EZONING OF L AND LOCATED E AST OF C OUNTY R OAD 101 NEAR P RAIRIE D RIVE (2017 032) WHEREAS, West Plymouth Development, Inc. has requested reclassification of the zoning from FRD (future restricted development) to PUD (planned unit development) and P-I (public/institutional) for roughly 75 acres located east of County Road 101 near Prairie Drive; and WHEREAS, the affected property to be rezoned to PUD is presently legally described as follows: That part of the West Half of the Southwest Quarter of Section 6, Township 118, Range 22, according to the United States Government Survey thereof, Hennepin County, Minnesota lying northerly and northeasterly of the following described line: Commencing at the southeast corner of said West Half of the Southwest Quarter; thence on an assumed bearing of North 00 degrees 23 minutes 13 seconds East along the east line of said West Half of the Southwest Quarter a distance of 356.30 feet to the point of beginning of said described line; thence northwesterly a distance of 322.71 feet along a non-tangential curve concave to the northeast, having a radius of 467.50 feet, a central angle of 39 degrees 33 minutes 00 seconds and a chord that bears North 50 degrees 04 minutes 08 seconds West a distance of 316.34 feet; thence northwesterly a distance of 509.31 feet along a reverse curve concave to the southwest having a radius of 1282.50 feet and a central angle of 22 degrees 45 minutes 12 seconds; thence North 53 degrees 02 minutes 50 seconds West, tangent to last described curve, a distance of 290.23 feet; thence northwesterly a distance of 53.24 feet along a tangential curve concave to the southwest, having a radius of 532.50 feet and a central angle of 05 degrees 43 minutes 43 seconds; thence North 57 degrees 16 minutes 55 seconds West, not tangent to last described curve, a distance of 50.13 feet; thence northwesterly a distance of 244.19 feet along a non-tangential curve concave to the southwest, having a radius of 500.00 feet, a central angle of 27 degrees 58 minutes 57 seconds and a chord that bears North 76 degrees 11 minutes 16 seconds West a distance of 241.77 feet; thence South 89 degrees 49 minutes 15 seconds West, tangent to last described curve, a distance of 103.16 feet to the west line of said West Half of the Southwest Quarter and said described line there terminating. WHEREAS, the affected property to be rezoned to P-I is presently legally described as follows: That part of the West Half of the Southwest Quarter of Section 6, Township 118, Range 22, according to the United States Government Survey thereof, Hennepin County, Minnesota lying southerly and southwesterly of the following described line: Resolution 2017-263 (2017032) Page 2 Commencing at the southeast corner of said West Half of the Southwest Quarter; thence on an assumed bearing of North 00 degrees 23 minutes 13 seconds East along the east line of said West Half of the Southwest Quarter a distance of 356.30 feet to the point of beginning of said described line; thence northwesterly a distance of 322.71 feet along a non-tangential curve concave to the northeast, having a radius of 467.50 feet, a central angle of 39 degrees 33 minutes 00 seconds and a chord that bears North 50 degrees 04 minutes 08 seconds West a distance of 316.34 feet; thence northwesterly a distance of 509.31 feet along a reverse curve concave to the southwest having a radius of 1282.50 feet and a central angle of 22 degrees 45 minutes 12 seconds; thence North 53 degrees 02 minutes 50 seconds West, tangent to last described curve, a distance of 290.23 feet; thence northwesterly a distance of 53.24 feet along a tangential curve concave to the southwest, having a radius of 532.50 feet and a central angle of 05 degrees 43 minutes 43 seconds; thence North 57 degrees 16 minutes 55 seconds West, not tangent to last described curve, a distance of 50.13 feet; thence northwesterly a distance of 244.19 feet along a non-tangential curve concave to the southwest, having a radius of 500.00 feet, a central angle of 27 degrees 58 minutes 57 seconds and a chord that bears North 76 degrees 11 minutes 16 seconds West a distance of 241.77 feet; thence South 89 degrees 49 minutes 15 seconds West, tangent to last described curve, a distance of 103.16 feet to the west line of said West Half of the Southwest Quarter and said described line there terminating. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected land from FRD to PUD and P-I. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request for reclassification of the zoning from FRD to PUD and P-I for roughly 75 acres as legally described above, based on the following findings: 1. The PUD zoning requested for the north portion of the site would be consistent with the requested LA-2 guiding for that portion of the site. 2. The proposed single-family land use and density is consistent with the requested LA-2 guiding for the north portion of the site. 3. The proposed single-family development plan and lot arrangement would comply with the requested PUD for the north portion of the site. 4. The P-I zoning requested for the south portion of the site is consistent with the current P-I guiding for that portion of the site. 5. Adequate infrastructure would be available to support the proposed development. APPROVED by the City Council on this 8th day of August, 2017.
