HomeMy WebLinkAboutCity Council Resolution 2017-259 C ITY OF P LYMOUTH R ESOLUTION N O. 2017-259 R ESOLUTION A PPROVING V ARIANCES FOR W AYZATA P UBLIC S CHOOL D ISTRICT FOR P ROPERTY LOCATED AT 4955 P EONY L ANE (2017 060) WHEREAS, Wayzata Public School District has requested approval of variances for: 1) a baseball scoreboard that is 275 square feet in area where 150 square feet is allowed; and 2) a softball scoreboard that is 190 square feet in area where 150 square feet is allowed at Wayzata High School at 4955 Peony Lane; and WHEREAS, the variances would allow construction of two scoreboards on the Wayzata High School Athletic Complex; and WHEREAS, the subject property is legally described as Lot 1, Block 1, Wayzata Senior High School Addn., Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Wayzata Public School District for variances for a baseball and softball scoreboard at Wayzata High School, subject to the following findings and conditions: 1. The requested variances are approved, in accordance with the application and plans received by the City on May 22, 2017, except as may be amended by this resolution. 2. The requested variances are approved, based on the finding that all applicable variance standards have been met. Specifically, a. The variances permitting the oversized scoreboards would be in harmony with the general purposes and intent of the P-I zoning regulations, which are intended to serve public activities and uses such as the high school and would be consistent with the City’s comprehensive plan. b. The applicant has demonstrated that there are practical difficulties in complying with the ordinance regulations because permitting the oversized scoreboards on the athletic complex allows the property to be used in a reasonable manner. c. The plight of the school district is unique. The only other public high school athletic complex in the city (Armstrong High School) has oversized scoreboards that were approved at a time when the City allowed larger scoreboards. The variances, if granted, would not alter the essential character of the locality: a) there is an existing scoreboard on the baseball field and b) the scoreboard on the softball field would be located roughly 450 feet away from the residential neighborhood to the south and given the orientation of the scoreboard and vegetation along the railroad tracks, it would have limited visibility from the neighborhood. e. The purpose for the variation is not based exclusively on economic considerations; but rather, the variances are requested to allow adequate and pertinent scoring information and to provide a ‘home court’ atmosphere for the student athletes. f. Granting the variances would not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood as there is an existing scoreboard on the baseball field and the location and orientation of softball scoreboard limits visibility from the neighborhood to the south. 3. A sign permit is required for each scoreboard prior to commencement of construction. 4. The variances shall expire one year after the date of approval, unless the property owner or applicant has commenced the authorized improvement or use, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under section 21030.06 of the Zoning Ordinance.
