SEPTEMBER 20, 1993
A special meeting forum of the Plymouth City Council was called to order by Mayor
Bergman at 6:35 p.m. in the Council Chambers of the City Center, 3400 Plymouth
Blvd., on September 20, 1993.
PRESENT: Mayor Bergman, Councilmembers Helliwell and Tierney,
Councilmember Vasiliou arrived at 6:45 p.m.
ABSENT: Councilmember Edson
STAFF PRESENT: Assistant City Manager Lueckert, Public Works Director
Moore, Community Development Director Hurlburt, Public
Safety Director Gerdes, and City Clerk Rauenhorst
St. Philip the Deacon Lutheran Church
Ed Brunken, 17200 14th Avenue North, stated there are ongoing noise problems with
respect to the air conditioning equipment at St. Philip the Deacon Lutheran Church,
17205 County Road 6. He questioned the credibility of the noise level monitoring
recently conducted by the State of Minnesota, and suggested that readings should have
been taken several feet above the ground and from his abutting property, and should
have included the entire air conditioning cooling process. He stated his concern is not
solely compliance with the laws, but whether the noise from the air conditioning
equipment is an intrusion on his enjoyment of his property.
Councilmember Helliwell asked if the heating equipment causes similar noise
problems, or if it is only caused by the air conditioning equipment.
Mr. Brunken stated that only the air conditioning equipment creates the noise problem.
Mayor Bergman suggested that since the air conditioning season is over, that the noise
test be conducted again in the spring at Mr. Brunken's address.
Councilmember Vasiliou suggested that the City not wait until next summer to address
the problem. She believes that a meeting should be held now with the neighbors and
church representatives to determine why this problem was not adequately resolved this
year. She stated that an agreement could be developed now so that procedures are in
place for 1994.
Request for Haunted Hayride
Dan Saad, 4005 County Road 101, represented Don Metz Orchard. He stated they are
planning a haunted hayride to run through Halloween. He stated that when he had
contacted staff at the end of August about this event, he was given incorrect

information on the type of permit needed. He has since been informed that a
conditional use permit is needed and it will delay the start date of this event. He
described the proposed parking, security, and access issues relating to the site. He
stated they are attempting to arrange all parking on the west side of County Road 101
so pedestrians will not have to cross that road.
Mayor Bergman stated he has no preconceived opinions about the application and will
wait to hear the Planning Commission recommendation following the public hearing.
Councilmember Vasiliou stated her primary concern is related to safety if pedestrians
are crossing County Road 101 at night. She stated that safety vests and hired security
may be able to address those concerns.
Sump Pump/Sanitary Sewer
Fred Lips, 14405 38th Ave. North, suggested that the Council consider requiring
underground pipes for the discharge of sump pump water for new construction, rather
than allowing sump pumps to discharge into yards.
Public Works Director Moore stated that sump pump water is prohibited from the
sanitary sewer system because of the tremendous cost to treat water that does not need
to be treated. He stated that a storm water drainage system connection would increase
costs considerably for developers and would only solve occasional problems.
Request for Stop Sign at 26th Ave. North and Shadyview Lane
Forrest Burke, 18205 26th Ave. North, stated he was representing 17 neighbors near
26th Avenue North and Shadyview Lane. He stated the topography of that
intersection makes it a safety hazard, and he requested that an east west stop sign be
installed at that intersection.
Director Moore stated staff does not support a 4 -way stop sign at this location. He
stated that when the required petition is verified, staff will bring the issue before the
Council for consideration in accordance with the Council's policy.
The meeting was adjourned at 7:05 p.m.
