HomeMy WebLinkAboutCity Council Resolution 2017-235 C ITY OF P LYMOUTH R ESOLUTION N O. 2017-235 R ESOLUTION A PPROVING A S ITE P LAN FOR A F OUR U NIT T OWNHOME ON P ROPERTIES LOCATED RD AT 14180 – 14192 43 A VENUE N ORTH (2017054) WHEREAS, Trust Builders and Developers, LLC has requested approval of a site plan to allow construction of a four unit townhome on the property presently legally described as Lots 1, 2, 3, 4, Block 2, Sandpiper Ponds, Hennepin County, Minnesota, according to the recorded plat thereof; and WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Trust Builders and Developers, LLC for a rd site plan to allow construction of a four unit townhome for property located at 14180-14192 43 Avenue North, subject to the following conditions: 1. A site plan is approved to allow construction of a four unit townhome and related improvements, in accordance with the plans received by the City on March 15, 2017 and May 3, 2017, except as amended by this resolution. 2. A separate building permit is required prior to commencement of the project. 3. Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Execute a site improvement performance agreement and submit the related financial guarantees and fees pursuant to section 21045.10 of the zoning ordinance. b. Obtain the required permit from the watershed districts. c. Satisfy any requirements from the Minnesota Pollution Control Agency (MPCA) or Hennepin County Department of Environmental Services relating to soil correction. d. Execute and record a maintenance agreement. e. Obtain city approval of final construction plans. f. Provide information confirming the existing ponds are adequate to treat the additional units. g. Provide documentation showing that the new units are part of the Sandpiper Ponds Homeowners Association as required. h. Revise the plans as follows: i. Submit a conforming lighting plan. ii. Submit fixture details including color rendering index (CRI), correlated color temperature (CCT) and backlight, uplight and glare (BUG) information. iii. On the landscape plan, include tree details (i.e. identify species and size), and provide at least 25 percent deciduous and not less than 25 percent coniferous trees. Resolution 2017-235 File 2017054 Page 2 iv. Add proposed contours to the site, utility and tree plans. v. Add drainage grades to the grading plan and if the drainage grade is less than two percent north of the structure, add drain tile and include City details. vi. Add lowest opening elevation for each lot on the grading plan. vii. Add swales between the structure and the berms on the grading plan. rd viii. Add inlet protection to the six inlets on 43 Avenue. Use a symbol and identify symbol to legend on the erosion control plan. ix. Add silt fence and/or rock entrance along the front property between the ends of silt fence shown on the erosion control plan. x. On the erosion control plan, add a second row of silt fence at the northeast corner in order to slow flow before it exits the site. rd xi. Identify the size, location and connection points of the water main on 43 Avenue and the private drive within Sandpiper Ponds on the utility plan. xii. Submit fire apparatus turning radius evaluations at the drive at the main entry location. 4. A City approved fire sprinkler system is required to protect all units. A fire hydrant in an approved location may be required at or near the structure depending on the fire sprinkler system that is installed. 5. Fire lane signage shall be provided in locations to be field identified by the fire inspector. 6. No construction traffic is permitted along the private drive in Sandpiper Ponds. rd Construction traffic shall be limited to on-site or along the public street portion of 43 Avenue. 7. Silt fence shall be installed prior to any construction on the site. 8. Standard Conditions: a. No trees may be planted in the public right-of-way. b. The applicant shall remove any diseased or hazardous trees. c. Compliance with the city’s lighting regulations. d. All signage shall comply with section 21155 of the zoning ordinance and shall receive sign permits if required. e. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. f. The site plan shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21045.09, respectively, of the zoning ordinance.
