HomeMy WebLinkAboutCity Council Resolution 2017-231 C ITY OF P LYMOUTH R ESOLUTION N O. 2017-231 R ESOLUTION A PPROVING F INAL P LAT AND D EVELOPMENT C ONTRACT FOR RD “C AMELOT N INE AT B EGIN 3 A DDITION” FOR P ROPERTY LOCATED AT THE F ORMER B EGIN O AKS G OLF C OURSE S ITE, 5635 Y UCCA L ANE (2017 056) WHEREAS, Pulte Homes of Minnesota has requested approval of a final plat for “Camelot Nine rd at Begin 3 Addition” consisting of 21 single-family lots and 27 townhomes lots, for property presently nd legally described as Outlot D, Camelot Nine at Begin 2 Addition, according to the recorded plat thereof, Hennepin County, Minnesota; and WHEREAS, City staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Pulte Homes of Minnesota for a final plat rd for Camelot Nine at Begin 3 Addition; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the City; and FURTHER, that the following conditions be met prior to recording of, and related to said plat: rd 1. The final plat for Camelot Nine at Begin 3 Addition is approved in accordance with the plans received by the City on May 11, 2017, except as may be amended by this resolution. 2. Prior to recording the final plat, the Developer shall: a. Receive City approval of final construction plans. b. Execute the development contract and provide the related financial guarantees and fees. c. Add and relocate hydrants to locations approved by the Fire Inspector. 3. The Developer shall install drain tile in rear or side yards, as required. Such drain tile shall be privately maintained. 4. Minimum building setbacks for single-family lots shall be as follows: a. Front yard: 25 feet. b. Side yards: 7.5 feet. (minimum of 15 feet between homes) c. Rear yard to other lots: 25 feet. d. Rear yard to outlots/open space: 20 feet. 5. No cantilever, chimney, porch, deck, stoop, air conditioner, egress window, or similar feature shall encroach into a drainage and utility easement. Resolution 2017-231 File 2017056 Page 2 6. Prior to issuance of building permits for lots that abut a wetland, permanent wetland buffer monument signs shall be installed pursuant to ordinance requirements. 7. The homeowner’s association documents shall address: a) responsibilities for maintenance, repair, and replacement of developer-installed retaining walls, wetland buffers, buffer monuments, sidewalks, trails, play features, dog park fencing, subdivision signage including signage within the landscaped island, and other similar or common features, and b) prohibition on the clearing of native vegetation within wetland buffers and conservation easement areas. 8. Fire Inspector comments to be addressed prior to issuance of building permits: Provide the total square footage, including all floor levels and attached garages, of the largest single-family detached and multi-family buildings. 9. In addition to required front yard trees, four trees shall be planted in the rear yard of Lots 1-10, Block 1 (single-family lots backing up to the wetland in the southwest portion of the site). Half of those trees shall be deciduous with a minimum caliper size of 2.5 inches, and half shall be conifers with a minimum height of six feet, pursuant to the approved Planned Unit Development. 10. Standard Conditions: a. No building permits, including those for a model home, shall be issued until the final plat is recorded with Hennepin County and streets and utilities are installed. b. Compliance with the City’s tree preservation and reforestation regulations. c. Removal of all hazardous trees from the property at the owner's expense. d. Except for the landscaped island at the site entrance from Cheshire Parkway, no trees shall be planted in the boulevard. e. If the required sidewalks are not installed when the streets are installed, no building permits shall be issued for lots abutting the future sidewalk unless a separate sidewalk agreement is provided for each affected lot. f. Any signage shall require a separate permit. g. Compliance with all fire codes, including those for hydrant location and fire lane signage. h. Separate building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in height. i. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 512 of city code.
