R ESOLUTION N O. 2017-213
R ESOLUTION A PPROVING THE V ACATION OF D RAINAGE
AND U TILITY E ASEMENTS WITHIN R OCKFORD E STATES
WHEREAS, a public hearing with respect to said vacation was scheduled for June 13, 2017 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to
the meeting of June 13, 2017; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail;
and
WHEREAS, the City Council held a public hearing on June 13, 2017 to inform any and all
interested parties relevant to the vacation of drainage and utility easements within Rockford Estates;
and
WHEREAS, it was determined by the City Council that said easements were not needed for public
purposes.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that that the following drainage and utility easements be vacated:
PROPERTY DESCRIPTION (PID: 15-118-22-34-0073)
Lot 1, Block 1, Rockford Estates, Hennepin County, Minnesota, and that part of Outlot D,
Rockford Estates, described as follows: Commencing at the southeasterly corner of Lot 1,
Block 1, Rockford Estates, which is the point of beginning; thence south along the easterly line
of said Outlot D, to the southeasterly corner of said Outlot D; thence west along the southerly
line of said Outlot D, 185 feet; thence north to the southwesterly corner of Lot 1, Block 1,
Rockford Estates; thence east along the southerly line of said Lot 1, Block 1, to the point of
beginning and there terminating, Hennepin County, Minnesota.
DRAINAGE AND UTILITY EASEMENT DESCRIPTIONS:
The south 6 feet except the east 10 feet and the west 6 feet of Lot 1, Block 1, Rockford Estates,
Hennepin County, Minnesota, and the north 6 feet except the east 10 feet and the west 12 feet
of that part of Outlot D, Rockford Estates, described as follows: Commencing at the
southeasterly corner of Lot 1, Block 1, Rockford Estates, which is the point of beginning; thence
south along the easterly line of said Outlot D, to the southeasterly corner of said Outlot D;
thence west along the southerly line of said Outlot D, 185 feet; thence north to the
southwesterly corner of Lot 1, Block 1, Rockford Estates; thence east along the southerly line of
said Lot 1, Block 1, to the point of beginning and there terminating, Hennepin County,
Minnesota.

BE IT FURTHER RESOLVED, that the recording of this vacation resolution shall be accomplished
with, but following the recording of the 12 foot grant of permanent easement for drainage and utility
purposes.
BE IT FURTHER RESOLVED, that said vacation shall not affect the authority of any person,
corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines,
sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or
thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to
maintain, repair, replace, remove, or otherwise attend thereof.
