R ESOLUTION N O. 2017-209
R ESOLUTION A CCEPTING S TREETS AND U TILITIES FOR C ONTINUAL M AINTENANCE
FOR F RETHAM 23 RD A DDITION (2014035)
WHEREAS, in accordance with the development contract dated November 25, 2014 and first
amendment dated January 15, 2015, Lake West Development, LLC, developer of Fretham 23rd Addition
(2014035), has agreed to install certain improvements for said development; and
WHEREAS, the developer has completed a portion of the street, utility and site grading as noted
below; and
WHEREAS, the developer has requested a reduction of the required financial guarantee to reflect the
completed work.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the financial guarantee requirements are reduced as follows below and that the required
financial guarantee and Letter of Credit No. 295 for the items be reduced from $191,984 to $135,095:

BE IT FURTHER RESOLVED that the utilities are accepted for continuous maintenance as of June 13,
2017, subject to the two-year guarantee by the Developer per Letter of Credit No. 295.
BE IT FURTHER RESOLVED that the streets are accepted for continuous maintenance as of June 13,
2017, subject to the one-year guarantee by the Developer per Letter of Credit No. 295.
