HomeMy WebLinkAboutCity Council Resolution 2017-182CITY OF PLYMOUTH RESOLUTION 2017-182 RESOLUTION DENYING A REQUEST FOR A PRELIMINARY PLAT AND VARIANCE TO CREATE AN UNDERSIZED LOT FOR PROPERTY LOCATED AT 1415 GARLAND LANE NORTH AND ADOPTING FINDINGS OF FACT (2017010) WHEREAS, Ken Heyda Design, LLC, has requested approval of a preliminary plat and lot area variance for roughly 0.83 acres of land presently legally described as follows: Lot 4, Block 1, Kreatz Highview Acres 3rd Addition, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it denies the request for a preliminary plat and variance to create an undersized lot, based on the following findings: 1. The subject property is guided LA -1 on the Plymouth Comprehensive Plan Land Use Plan. 2. The subject property is zoned RSF-1 on the Plymouth Zoning Map. 3. The applicant is requesting to subdivide the existing 36,050 square -foot parcel into two single- family lots. One lot would contain 17,550 square feet in lot area where 18,500 square feet is required in the RSF-1 zoning district (950 square feet short of the conforming lot size). The second lot would contain 18,500 square feet and meet the minimum lot size. 4. The applicant has not shown that there are practical difficulties or unique circumstances in complying with the Chapter. A lot larger than the minimum lot size in the district is not unique and is not a practical difficulty. 5. The variance, if granted, would alter the essential character of the neighborhood as the proposed lot would be smaller than the adjacent lots. 6. The variance request is based exclusively upon economic considerations. 7. The current use of the property for a home provides a reasonable use of the property for the applicant.
