HomeMy WebLinkAboutCity Council Resolution 2017-118 C ITY OF P LYMOUTH R ESOLUTION N O. 2017-118 R ESOLUTION A PPROVING A S ITE P LAN A MENDMENT AND C ONDITIONAL U SE P ERMIT A MENDMENT FOR AN A DDITIONAL P RINCIPAL B UILDING AND P AVEMENT R EPLACEMENT P ROJECT AT C LIFTON E. F RENCH R EGIONAL P ARK L OCATED AT 12605 and 12655 R OCKFORD R OAD (2017012) WHEREAS, Three Rivers Park District has requested approval of a site plan amendment and conditional use permit amendment to allow construction of an additional cold-storage building and related improvements and a pavement replacement project for Clifton E. French for the property presently legally described as follows: That part of the southwest quarter of the northwest quarter, described as beginning at the southwest corner thereof, thence on an assumed bearing of north 0 degrees, 18 minutes, 5 seconds west along the west line thereof 374.13 feet thence north 60 degrees, 19 minutes, 41 seconds east 506.51 feet thence northeasterly along a tangential curve concave to the southeast, having a radius of 4,545.66 feet a distance of 215.4 feet, thence southeasterly to a point on the east line of the west 867 feet of the southwest quarter of the northwest quarter a distance of 255 north from the south line thereof, thence south along said east line to the south line thereof, thence west to the beginning except roads, all located in Section 14, Township 118, Range 22, Hennepin County. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Three Rivers Park District for a site plan amendment and conditional use permit amendment, subject to the following conditions: 1. A site plan amendment is approved to allow construction of an additional cold-storage building and related site improvements and a pavement reconstruction project, in accordance with the plans received by the city on January 27 and February 8, 9, 10, and 13, 2017 except as amended by this resolution. 2. A conditional use permit amendment is approved to allow another principal building on the site with the finding that the proposal complies with all applicable conditional use permit standards. 3. Separate building and grading permits are required prior to commencement of the project. Resolution 2017-118 File 2017012 Page 2 4. Prior to issuance of the building or grading permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Submit an executed site improvement and performance agreement and related financial guarantees. b. Obtain required permits from Hennepin County and watershed district. c. Obtain city approval of final construction plans. d. Submit the minimal impact design calculator. e. Revise the plans as follows: i. Revise the landscaping plan to indicate the trees will be planted consistent with the minimum planting size of 2.5 caliper inches. ii. Provide the lumens per square foot for the visitor center parking lot, field operations center parking lot and the boat ramp area. iii. Add an ADA pedestrian ramp to the trail connection at Old County Road 9. iv. Lower ST-112 so that the catch basin is four feet deep. v. Indicate the seed/sod mixture for the rain garden. vi. Add a note to the plans that all drives shall be constructed to the required seven- ton standard. vii. Add an approved fire turnaround at the field operations center parking lot. 5. The applicant shall submit the following executed easements and agreements: a. A maintenance agreement covering the rain gardens and porous pavements. b. A 20-foot wide easement(s) over the following storm sewer mains: i. FES 3A to ST-3 to FES-3B. ii. FES 110 to ST-112. nd 6. When the third phase of the project is completed, the temporary vehicle connection to 36 Avenue shall be removed and restored to pre-construction condition. Should the completion of the project occur outside the growing season, the applicant shall complete the landscaping restoration of the area by June 1, 2018. 7. Consider adding an east-west trail adjacent to the property along Rockford Road (County Road 9). 8. Hydrants must be visible and accessible at all times. 9. Silt fence shall be installed prior to any construction on the site. 10. Fire lane signage shall be provided in locations to be field identified by the fire inspector. 11. Standard Conditions: a. The applicant shall remove any diseased or hazardous trees. b. No trees may be planted in the public right-of-way. Resolution 2017-118 File 2017012 Page 3 c. Any rooftop/ground-mounted equipment shall be screened consistent with the requirements of section 21130.05 of the zoning ordinance. d. Compliance with the city’s lighting regulations. e. Any signage shall comply with section 21155 of the zoning ordinance and shall receive sign permits if required. f. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. g. The site plan amendment and conditional use permit amendment shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21045.09 and 21015.07, respectively, of the zoning ordinance.
