R ESOLUTION A PPROVING A GREEMENT WITH THE
B ASSETT C REEK W ATERSHED M ANAGEMENT C OMMISSION FOR
S TORM W ATER I MPROVEMENTS WITH THE A GORA D EVELOPMENT (2016075)
WHEREAS, on November 13, 2012, the City of Plymouth entered into a Cooperative Agreement
with the Bassett Creek Watershed Management Commission for construction of the Four Seasons Mall
Water Quality Improvements consisting of stream restoration and water quality ponding to reduce
phosphorus loading downstream to Northwood Lake; and
WHEREAS, the stream restoration project was objectionable to a number of adjacent residents
due to tree loss and this project has since been on hold pending an opportunity to cooperate on storm
water improvements with re-development of the Four Seasons Mall site; and
WHEREAS, on January 17, 2017, the City Council approved the preliminary plat for the Agora
Development; and
WHEREAS, on February 16, 2017, the Bassett Creek Watershed Management Commission
approved a capital improvement construction agreement to provide funding up to $850,000 for storm
water improvements constructed in excess of regulatory requirements on the Agora site; and
WHEREAS, the storm water improvements to be constructed cooperatively with the Agora
development are proposed to be equivalent to the previous stream restoration and ponding project;
and
WHEREAS, the Bassett Creek Watershed Management Commission requires the City of
Plymouth to perform long term maintenance on the wetland restoration improvements.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that:
1. The cooperative agreement with the Bassett Creek Watershed Management Commission
dated September 20, 2012 for construction of the Four Seasons Mall Water Quality
Improvements is terminated.
2. The Mayor and City Manager are authorized to enter into the Capital Improvement
Construction Project Agreement for the Agora Development dated March 16, 2017.
