HomeMy WebLinkAboutCity Council Resolution 2017-114 C ITY OF P LYMOUTH R ESOLUTION N O. 2017-114 R ESOLUTION A PPROVING AN E NCROACHMENT A GREEMENT FOR A S HARED U SE R ESIDENTIAL D RIVEWAY ON LOTS 29 AND 30, B LOCK 2, E LM C REEK P LACE WHEREAS, property owner Peter Jarvis, Elm Creek Meadows LLC, requested the City to approve an encroachment agreement allowing a shared use residential driveway for side loaded garages to be constructed within drainage and utility easements on Lots 29 and 30, Block 2, Elm Creek Place; and WHEREAS, the encroachment agreement permits only a shared use residential driveway within easements and all related facilities must still meet all applicable City codes; and WHEREAS, the owner’s properties are legally described as Lots 29 and 30, Block 2, Elm Creek Place. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the encroachment agreement that will allow the proposed shared use residential driveway on drainage and utility easements over Lots 29 and 30, Block 2, Elm Creek Place is approved.
