R ESOLUTION N O. 2016-362
R ESOLUTION D ENYING THE V ACATION OF A S TREET E ASEMENT
ON 9 TH A VENUE IN C ITY V IEW A CRES 2 ND
WHEREAS, a petition was filed requesting the vacation of a public street easement on 9th
Avenue (formerly Lake View Drive) within City View Acres 2ndUnit, which lies within the City of
Plymouth, Hennepin County, Minnesota; and
WHEREAS, a public hearing with respect to the vacation was scheduled for November 29, 2016,
in accordance with Minnesota Statutes 412.851 and City Charter Section 12.06; and
WHEREAS, a notice of the hearing was published and posted two weeks prior to the meeting of
November 29, 2016; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail;
and
WHEREAS, the City Council held a public hearing on November 29, 2016 to inform any and all
interested parties relevant to the vacation of the easement.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the Petition is denied and the street easement is not vacated based upon the following
findings:
1. The street easement provides an opportunity for public access to Gleason Lake.
2. The Minnesota Department of Natural Resources has recommended that the
easement not be vacated because it can provide access to public waters.
3. It is not in the interest of the public to vacate the easement.
APPROVED by the City Council on this 29th day of November, 2016.
