HomeMy WebLinkAboutCity Council Resolution 2016-334 C ITY OF P LYMOUTH R ESOLUTION N O. 2016-334 R ESOLUTION A PPROVING A S ITE P LAN A MENDMENT AND C ONDITIONAL U SE P ERMIT A MENDMENT FOR W AYZATA E VANGELICAL F REE C HURCH FOR P ROPERTY L OCATED AT 705 C OUNTY R OAD 101 (2016076) WHEREAS, BWBR Architects has requested approval of a site plan amendment and conditional use permit amendment to allow construction of a building addition and related site work for property located at 705 County Road 101 and legally described as follows: That part of the Southeast Quarter of the Southeast Quarter of the Northeast Quarter of Section 31, Township 118 North, Range 22 West of the 5th Principal Meridian, and lying Southerly of a line described as follows: Beginning at a point on the West line thereof; distant 195.02 feet South of the Northwest corner of said Southeast Quarter of the Southeast Quarter of the Northeast Quarter; thence East parallel with the North line of said Southeast quarter of the Southeast Quarter of the Northeast Quarter a distance 439.4 feet; thence South at right angles a distance of 50.00 feet; thence East at right angles, to the East line of said Southeast Quarter of the Southeast Quarter of the Northeast Quarter, and there ending. EXCEPT, that part of the South 151.00 feet thereof lying West of a line drawn North perpendicular to the south line of said Northeast Quarter from a point on said South line distant 393.07 feet West of the Southeast corner of said Northeast quarter, ALSO EXCEPT, That part of the remainder of said land lying within the circumference of a circle having a radius of 50 feet, the center of said circle being at a point 40 feet North on a line drawn North perpendicular to the South line of said Northeast quarter from a point on said South line distant 363.07 feet West of the Southeast corner of said Northeast quarter. And, Lot 2, Block 1 NOLAN ADDITION, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by BWBR Architects for a site plan amendment and conditional use permit amendment for a building addition and related site improvements at the Wayzata Evangelical Free Church, subject to the following conditions: 1. A site plan amendment is approved to allow construction of a roughly 9,350 square foot addition on the south side of the existing building and related site improvements, in accordance with the plans received by the city on August 22, 2016 and September 26, 2016, except as amended by this resolution. A conditional use permit amendment is approved to allow expansion of the existing church with the finding that the proposal complies with all applicable conditional use permit standards. 3. A separate building permit is required prior to commencement of the project. 4. Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Replace the driveway aprons and sidewalk along County Road 101. b. Revise the plans consistent with the graphic submitted October 3, 2016. c. Receive city approval of final construction plans. d. Submit an executed site improvement and performance agreement (SIPA) and related financial guarantees. e. Submit an approved permit from the Minnehaha Creek Watershed District. f. Consistent with the zoning ordinance and engineering guidelines, revise the plans as follows: 1) Provide six-feet of screening between the south parking area and the adjacent property. 2) Indicate trash dumpster storage either inside the building or in an enclosure. 3) Submit the correlated color temperature (CCT), color rendering index (CRI) and backlight, uplight, glare (BUG) information for the proposed light fixtures. 4) Add and relocate hydrants to approved locations. 5) Identify the existing site hydrants and post indicator valve. 6) Identify the size of the water main/service on the plans. 7) Add a solenoid valve on the domestic water supply. 5. Silt fence/bioroll shall be installed prior to any construction on the site. 6. Fire lane signage shall be installed in locations to be field identified by the fire inspector. 7. Standard Conditions: a. No variances are granted or implied. b. Any rooftop equipment shall be screened to match the building. c. Compliance with the city’s lighting regulations. d. Any signage shall comply with section 21155 of the zoning ordinance and shall receive sign permits if required. e. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. f. The site plan amendment and conditional use permit amendment shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21045.09 and 21015.07, respectively, of the zoning ordinance.
