R ESOLUTION A PPROVING THE V ACATION OF D RAINAGE E ASEMENT
IN S ECTION 7 L YING N ORTHEAST OF S TATE H IGHWAY N O. 55 AND S OUTHWEST OF O LD
R OCKFORD R OAD
WHEREAS, a public hearing with respect to said vacation was scheduled for October 25, 2016, in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of October 25, 2016; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by
mail; and
WHEREAS, the Council held a public hearing on October 25, 2016 to inform any and all
interested parties relevant to the vacation of easement for drainage purposes in Section 7 Lying
Northeast of State Highway No. 55 and Southwest of Old Rockford Road; and
WHEREAS, it was determined by the City Council that said easement was not needed for public
purposes.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the following drainage easement be vacated:
DESCRIPTION OF PROPERTY: (PIN 07-118-22-34-0001)
Parcel 1:
That part of the East ½ of the East ½ of the Southwest Quarter Lying North of State Highway No.
55 and South of the center line of Hennepin County Road No. 9, Section 7, Township 118, Range
22, Hennepin County, Minnesota.
Parcel 2:
That part of the East ½ of the Northeast Quarter of the Northwest Quarter of Section 18,
Township 118, Range 22, lying North of State Highway No. 55, Hennepin County, Minnesota.
DESCRIPTION OF DRAINAGE EASEMENT:
A 20 foot wide easement for drainage purposes over, under, and across that part of the East ½
of the East ½ of the Southwest Quarter of Section 7, Township 118, Range 22, Hennepin County,
Minnesota, the centerline of said easement is described as follows:
Commencing at the southeast corner of said Southwest Quarter, thence North 00 degrees 36
minutes 04 seconds East, assumed bearing along the east line of said East ½ of the East ½ of the
Southwest Quarter, a distance of 303.07 feet to the southerly right of way line of Old Rockford
Road, formerly known as Hennepin County State Aid Highway No. 9, Plat 9, recorded as
Document No. 997088, Office of the County Registrar, Hennepin County, Minnesota; thence
North 54 degrees 55 minutes 19 seconds West along said southerly right of way line a distance
of 158.52 feet to the point of beginning of said centerline; thence South 79 degrees 06 minutes
00 seconds West, a distance of 102.31 feet; thence South 75 degrees 55 minutes 36 seconds
West, a distance of 74.17 feet; thence South 78 degrees 42 minutes 19 seconds West, a
distance of 66.79 feet; thence North 84 degrees 34 minutes 22 seconds West, a distance of
79.56 feet to the northerly right of way line of State Highway No. 55, as monumented, and said
centerline there terminating. The side lines of said easement are prolonged or shortened to
terminate at said northerly right of way line of State Highway No. 55 and at said southerly right
of way line of Old Rockford Road.
BE IT FURTHER RESOLVED, that the Drainage Easement includes a portion of a 10 foot wide
Public Utility and Drainage Easement per Document No. 3745086 and that the Drainage portion shall be
retained by the City.
BE IT FURTHER RESOLVED, that said vacation shall not affect the authority of any person,
corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines,
sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or
thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to
maintain, repair, replace, remove, or otherwise attend thereof.
